It's going to be the FDRQ Elena Kagan or Kathleen Sullivan (also a FDRQ). The stinking poo-flinging animal in the White House is catering to the sodomite lobby and wants to give them their own Justice.

If it is anyone over 55 I will be shocked. Got to have someone old enough to be sure of their liberal bona fides, but still young enough to be on the court for a long long time.

Hilary would not go down in flames, its traditional for the Senate to give one of their own a free pass. I expect to see Hilary later if they lose control of the Senate not now.

We have only 41 in the Senate.

If Obama proposes a radical liberal, then he might cause those 41 to come together.

If he proposes a moderate/liberal, then McCain’s gang of 14 (7 pubs) are already on record willing to support a “reasonable” choice.

Is it justiciable? Haven’t most of these cases been kicked for saying congress and the states are the ones to ensure eligibility?

I know of no cases on this issue which have been "kicked out" on those grounds. Do you have a citation for one?

The Republicans have already sent word to Obama, not to appoint another ideologue. The president is going to try to rush through before the election in November. Our best hope is to hold off any nomination until next year, when the Democrats will lose control of Congress and hopefully the Senate.

Well, the democrats used the filibuster to prevent appeals nominees from being appointed well over nine months.

The GOP has little chance in making the public aware of how radical the nominee is without using or threatening to use the filibuster. Regardless, the GOP will attack and the left will spread blatant lies leaving the public confused.

The result is that a significant portion of the public will be in the dark until well after the nominee is confirmed.
