If they discharge him, that alone should give him standing, from what I read and understand.

Just by charging him and taking him to trial, he'll have standing. If he loses at trial, he'll the right to appeal the rulings made during the trial.

Off the top of my head, it happens when hospitals collect the day's or a couple of days' birth records, from the nurses and put them together in a stack. That stack goes to the county registrars office, where they go into an in-box with a bunch of other records from other hospitals. The clerk there works through the stack without sitting there and looking at the birth times of each record to make sure that they're in proper order. Maybe there's a big stack that day and the clerk takes half the records and hands them to the person at the next desk. Do you have any evidence that the registration number on Hawaii birth certificates is intended to be a precise record of the exact order in which births took place?

Nice try, but his COLB shows a filing date, with the state registrar, IIRC, 3 days earlier, while the number on his is *higher* than those filed later.

There has got to be better ways to protest then disobeying a military order. He should serve for his fellow troops if nothing else.

Granted, it is unconventional, but he is serving his fellow troops in a manner that no others have been willing to step forward and take up.

This is especially true if he can be granted legal standing to request 0's Long Form Birth Certificate, and even more true if it actually leads to the State of Hawaii producing said document.

Hawaiian officials in response to a UIPA request regarding protocol of handling & filing birth certs stated that the certificate number was issued the day the cert was filed. Obama’s says it was filed on Aug 8, 1961, the Nordyke certs were filed on Aug 11, 1961. Thus according to the recent response from HDOH, Obama’s cert number should precede that of the Nordyke certs, not follow it. Outlaying islands followed protocol of shipping/mailing certs in bulk, but not hospitals that are mere blocks from the state office and the filing dates on Obama’s & the Nordykes certs prove that.

A decorated man with a bronze star and distinguished service record, facing a prison sentence, is at least entitled to defend himself with documented facts that the Honorable Kenyan president has said do exist.

So, I wonder if Hawaii would be legally obligated to forward all documents. I would understand the court not being able to force a Kenyan citizen to comply, but Hawaii should be forced to open its records. We dont want an innocent man in prison in order to protect a Kenyan citizen.

The answer to your question is because the Certification of Live Birth is the official birth document of the state of Hawaii and there is no relevant additional information on the old long form that pertains to constitutional eligibility to be president.

But if you absolutely MUST see the original, vault copy, long form, wouldn’t it be better to have it subpoenaed directly from the state rather than trusting a document released BY Obama? The Republican Attorney General of Hawaii, Mark L. Bennett has statuatory independent subpoena power but he hasn’t chosen to exercise it to quickly resolve this issue, unfortunately. A subpoena before election day might have done wonders.

Interesting, but still explainable as simply bureaucracies and stacks of paperwork on desks. Stack of papers from hospital comes into registrars office, Obama’s among them. They’re accepted with a stamp that says “Filed.” That stack goes off to someone’s desk for processing into birth certificates. That person doesn’t get them all processed that day. The next day more come in and more the day after that. These new ones go onto the stack. The person processing the forms doesn’t work from the bottom of the stack but from the top, because the numbers don’t actually indicate birth order or filing order, but just a bureaucratic tracking number.

I don't believe you can say the Doctor is doing this to get out of anything. He has earned the following awards and commendations: Army Flight Surgeon's Badge, Combat Medical Badge, the Bronze Star Medal, the Meritorious Service Medal, the Army Commendation Medal with three Oak Leaf Clusters, the Army Achievement Medal with two Oak Leaf Clusters, the National Defense Service Medal with Bronze Service Star, the Armed Forced Expedition Medal, the Army Reserve Component Achievement Medal, the Army Service Ribbon, the Overseas Service Ribbon and the NATO service medal.

As far as following orders "to the death", the oath a commissioned officers takes when they enlist is

"I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God." (Title 10, US Code; Act of 5 May 1960 replacing the wording first adopted in 1789, with amendment effective 5 October 1962).

Key wording is "you are defending the constitution" and "obeying orders from the President of the United States" which is the whole point:

His contention is "he is NOT the legitimate President ACCORDING to the constitution. The certificate of live birth wouldn't get your child into Little League. If you contend otherwise - simply give me the name of the attending doctor and the hospital listed on the certificate!!!!!!!
