Judge Blocks Parts Of Arizona Immigration Law

PHOENIX – A judge has blocked the most controversial sections of Arizona's new immigration law from taking effect Thursday, handing a major legal victory to opponents of the crackdown.

The law will still take effect Thursday, but without many of the provisions that angered opponents — including sections that required officers to check a person's immigration status while enforcing other laws.

Arizona has two choices IMHO. One, since this is only an injunction, fight on; or two, draft new legislation to correct.

I believe that Arizona does not provide driver’s licenses to illegals, so the law could be changed to specifically address confirming the identity of ALL persons, stopped for other reasons. Then it is not only an immigration law because there are other reason a person may not carry proper ID. The law should not single out immigration status but should include checking for wants, warrants and any reason a person maybe without proper ID.

Obama is going to wish he lost this decision. This will only galvanize voters for the GOP.

That was my first thought. This is actually very bad news for the Dems. The pissed-off center-right voters, plus the disillusioned independents who voted for the Kenyan (the majority of voters) who are already motivated to go to the polls in November, will be really enraged now. The libs may celebrate now but they aren't going to know what hit them in November.

Al Queda just won. You can’t ask a suspected terrorist for their ID. This is no doubt an activist judge. If the Republicans plays this correctly this ruling will hurt the dimoKKKRATS in November.

I am no longer convinced there is a critical mass of intelligent, aware Americans to administer said Bad Karma.

This is even less likely with the upcoming dilution of the voting base with racist Hispanics who will vote Democrat in > 85% numbers.

It's interesting that I've not seen any reference to US Code 1252c:

§ 1252c. Authorizing State and local law enforcement officials to arrest and detain certain illegal aliens

(a) In general
Notwithstanding any other provision of law, to the extent permitted by relevant State and local law, State and local law enforcement officials are authorized to arrest and detain an individual who—
(1) is an alien illegally present in the United States; and
(2) has previously been convicted of a felony in the United States and deported or left the United States after such conviction,
but only after the State or local law enforcement officials obtain appropriate confirmation from the Immigration and Naturalization Service of the status of such individual and only for such period of time as may be required for the Service to take the individual into Federal custody for purposes of deporting or removing the alien from the United States.
(b) Cooperation
The Attorney General shall cooperate with the States to assure that information in the control of the Attorney General, including information in the National Crime Information Center, that would assist State and local law enforcement officials in carrying out duties under subsection (a) of this section is made available to such officials.

1252c specifically authorizes states to arrest and detain certain illegal aliens. How does this judge expect the states to comply with 1252c if they cannot first determine if the person is an illegal alien, and then determine if said illegal alien has committed a felony?

You are correct that it is just a preliminary injunction. However one of the criteria a judge must apply in granting a preliminary injunction is that there is a high probability that the plaintiff will ultimjately succeed on the merits of the case. Put simply, she has said there is a good chance she will find for the Feds.

Telemundo and Univision news are running gloating, non-stop coverage of this, interviewing illegal aliens in front of the Arizona Capitol. And now Telemundo is interviewing someone in Mexico City who is gloating. My head hurts.
