Attorney says Fort Hood (Nidal Hasan) hearing should be closed (nothing to see here, move along)

...Defense attorney John Galligan wants next month's Article 32 hearing for Maj. Nidal Hasan (nih-DAHL' hah-SAHN') closed to the public, including the media and victims' relatives. An Article 32 hearing is similar to a civilian grand jury proceeding.

... Galligan says he's worried about Hasan's ability to get a fair trial if the Article 32 hearing set for Oct. 12 is kept open.

Hasan, an Army psychiatrist, is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the Nov. 5 shootings in a building on the Texas Army post.

It is the DEFENSE position that they should be closed.

The Prosecution (i.e. the governments position) is that they should be open.

The editorial comment in the headline gave the mistaken impression that this was some sort of cover-up, a further downplaying of this by our government, rather than a sensible move by a Defense attorney in protecting his client.

The media has already tried calling this a case of “workplace related violence”, like someone in a mailroom or who’s been fired.

What gets me is that all his pre-massacre activities didn’t seem to raise eyebrows, but a NJ Transit worker who burns pages from a Koran at a 9/11 rally is immediately fired.

I would think that first amendment protections would apply to a public employee at least as much as to a member of the military.

Nidal Hasan was even communicating with terrorists abroad.

He was kept in position because of political correctness.

We’ve been told that as tragic as the shooting of nearly 50 Americans was, it would be “even more tragic” if it lessened our tolernace and diversity in the military, no matter what the transgressions of the figure (like making death threats and communicating with terrorists).

I know. I found that attitude from the US military commander absolutely disgusting.

We can’t win a war against jihad if we deny we are even facing a threat.

That's hilarious - Galligan has constantly been in the local newspapers or on TV around here yapping about his poor little client to the public - if he's so worried about any "ability to get a fair trial" maybe he should start by closing his own trap.

Are grand jury proceedings usually open to the public or not? Thought so. Art 32 is a grand jury proceeding in a military court.

Due process is due process. Then hang him.

Obama and Holder will make sure that this trial takes place after the mid-terms and that the “grand jury” hearings next month are closed as much as possible. This undercuts the theme that Islam is the religion of peace and that American Muslims are loyal and trustworthy.

Maj. Nidal Hasan is a Mass Murdering Muslim motivated by his fanatical belief in Islam and his hatred for America.

Judge Roy Bean presiding would say:

Your goig to get a fair trial. We’re going to find you guilty and hang you later today. Do you have anything to say? If you do I’ll hold you in further contempt and we’ll carry out the sentence much earlier.
