I hope the new congress will impeach the original judge. Obviously she is out of the mainstream, (I won’t hold my breath).

They didn't have a choice, believe me. If they did assert that a single federal judge could act in such a manner there was nothing to stop a single federal judge from stopping Obamacare nationwide.

At least that was my thought as to why rabid pro homosexual leftists would oppose this at all.

Where does the judicial branch of our government get the balls to tell the military that they have any say whatsoever in the military's recruiting process?

9th U.S. Circuit Court did something right...

They are just trying to push this issue off until after the election. they know that most Americans don't agree with the decisio0n to allow gays into the military and don't want Democrats to pay the price for it on Nov 2nd.

After Nov 2nd, they will jam this down our throats.

I missed something somewhere, but I thought if DADT was struck down, the original regulation would be followed.

I have heard that somewhere but I am looking for the actual proof...I know DADT was a policy but I am trying to determine the law that back it up.

I would think that the base document is the UMCJ. I do not think that the UCMJ specifies that homosexuality itself is a crime but it does deal with such issues as sodomy and conduct prejudicial to the service. The UCMJ is promulgated and authorized by Congress. Congress is the sole arbitrator of these issues under the constitution despite contrary court rulings from judges gone wild.

Article 125—Sodomy

Text

“(a) Any person subject to this chapter who engages in unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy. Penetration, however slight, is sufficient to complete the offense.

(b) Any person found guilty of sodomy shall by punished as a court-martial may direct.”

Elements.

(1) That the accused engaged in unnatural carnal copulation with a certain other person or with an animal. (Note: Add either or both of the following elements, if applicable)

(2) That the act was done with a child under the age of 16.

(3) That the act was done by force and without the consent of the other person.
