U.S. Democrat Sees Health Law Surviving Repeal Move

WASHINGTON – A leading U.S. Senate Democrat said Tuesday that President Barack Obama's healthcare overhaul will likely survive an effort by Senate Republicans to repeal the year-old law.
Senator Charles Schumer told reporters that there is enough support in the Senate to keep the healthcare law intact. All 47 Senate Republicans have backed a bill to repeal the law. But that falls short of the 60 needed to overcome procedural hurdles in the 100-member Senate. Republicans may try to offer the repeal, which pass the House on Jan. 19, as an amendment to an unrelated airline safety bill as early this week.

You may keep it intact but it’s unconstitutional.
If it fails to gain cloture this time, post it to the next bill to come down the line...

So - they're voting on something that doesn't exist. Interesting.
While I agree with and want the repubs to do this I hate the fact that any dems that need to for thier re-election hopes in 2012, will choose to vote for repeal just for the chance to say they did. The dems could let twelve of their own do this and we still would not be able to get it repealed. Then we have twelve possibly vulnerable dems who look moderate because they now support repeal when they really don’t.
The Republicans should cancel the vote as NOT NECESSARY
And immediaterly begin acting as if this is a done deal, because it’s been ruled unconstitutional.
I believe that this nightmare needs to get to the Supreme Court of the United States ASAP.... immediately.
It definitely won’t get a filibuster-proof majority. It will, however, provide excellent fodder for election commercials in 2012. And as the truth about Obamacare increases from a trickle to a flood, those who support it do so at their own peril. If the Supreme Court sides with the brilliant Judge Vinson, that this 3000 page pile of dreck is actually unconstitutional dreck, Obama and his sycophants in the Senate will be joining the almost 10% of the population who are unemployed.
Correct - BUT - they're the same folks who voted FOR Commiecare™. They'll have to explain the flip-flop. That's not going to be pretty.

Repeal is being presented as an amendment on another bill...so, it’s UP or DOWN...
With 47 solid R votes... only a handful of Dem switches are needed.
Every Rat running for election in 2012 is sweating right now! That makes me smile inside! :-)
Heard today that my rat senator, Joe Manchin, is signed up to support repeal. That kind of surprised me.
Make the dems show their hole cards; make them go on record. Even democrat voters will remember their senator’s vote for an unconstitutional law.

Not moot, for two reasons.
a) The law could survive appeal
b) Congress repealing it would be a frontal slap in the teeth to The One — much more embarrassing and damaging to his 2012 chances. Striking it down judicially is more like a kick in his keister from the rear — satisfying but not as in-your-face direct.
To actually ensure the crappy bill is dead, however, it’s good to have both legislative AND judicial repeal in place. Conventional wisdom says he’d never sign a repeal. I’m not so sure — he might do so as a political triangulation to attempt to save his scrawny neck.
