But evidently not enough support in that elusive other branch of government Shumer doesn't admit exists...the Judicial.

This, coming from a dem just re-elected in a perennially safe seat in a hopelessly dem state. He won't ever have to face the political music for supporting this mess. Others -- who come up for reelection in 2012 -- will. And if they don't get it before 2012, they will after they take control afterward.

The Senate will vote on the bill tomorrow instead!

Looks like Schumer and Reid decided that they had a few shaky Democrats to take care of. Of better worded, “They had to shake a few Democrats first.”

Of course... if it DID pass, Obama would veto it. And, we presumably would not be able to get 60 votes to over-ride. But, you know what? Let's go ahead and go down that road.

With THAT kind of attention, the American people MIGHT just convince enough scared Rats to change their minds...

Repeal is being presented as an amendment on another bill...so, it's UP or DOWN...

The fact that it's an amendment does not preclude an objection to limiting debate (that is, voting to pass or reject the amendment). The 60 votes of cloture is used to force the end of debate; and is often used in the context of an amendment to a bill.

The DEMs can kill the amendment with a motion to table. Motions to table aren't debatable, and 50 votes gets the amendment out of the picture. They likley won't move to table, that's the real "nuclear option" in Senate procedure.

Doesn’t matter that a judge declared it unconstitutional. If Congress can repeal it now, and assuming it doesn’t get vetoed, then the justice dept has no grounds for appeal. No chance for a reversal. KEEP AT IT! One victory does not win the war!

Ever heard of the Patriot Act? CFR? Roe V. Wade? just to name a few? Never underestimate this Dictatorship we now live under. And you will sleep better at night.

I hope it goes in our favor like everyone else, but there are many hurdles to jump first before the race is over.

Exactly/ If Obama "proceeds" as if the court hadn't riuled Obamacare null and void (Unconstitutional), it only takes one Attorny General in one of the states that were part of this suit to file an action with the Judge asking for an injunction due to their contempt of the court.

Rush thought it would be highly problematic that a federal marshal would arrive at the White House to arrest the man-child for contempt of court. You get into all sorts of constitutional difficulties when you start talking about arresting a president.

A repeal vote would be redundant as the courts have already taken care of this.

Redundant...until the administration requests a stay on Vinson's decision from the Appellate court, so that they can continue their implementation.

Redundant...until the Appellate court or, God help us, SCOTUS reverses Vinson's decision.

So long as the issue is going thru the courts, it's in suspended animation -- awaiting only a judicial jolt to awaken and lay waste to America.

But, if Obamacare is repealed, it will be dead and buried -- with a wood stake through its heart and a silver bullet thru the head.

As Judge Napolitano explained on FBC, Vinson’s ruling only applies in his district. Thus, technically, it is legal to keep implementing it elsewhere in the country. Now, it may be chaotic to implement everywhere but Vinson’s district, but technically it’s still legal. Until SCOTUS rules, things will be in chaos as states, insurers, businesses, families all watch and wonder whether they’re going to be impacted by Obamacare down the road. Hard to make decent long-term decisions about things such as hiring etc. without knowing the answers to these questions.

Thus, the cleanest outcome at this juncture would be to kill the beast and start over. The ball is in the Senate’s court and if Obama wants to veto it, let HIM explain why it’s a good idea to subject the country to a massive amount of uncertainty just as the economy had started to turn around. I don’t see any way this issue is a political winner for Dems in general or Obama in particular. The more Dems figure that out, the hard it will be for Harry Reid to control his members.

I think the issue is the so called “Pay Go” rule. If I understand that correctly, if an amendment adds to budget deficits, a “point of order” can be raised under the rules, and it takes 60 votes to clear the “point of order.”
