JEFFERSON CITY — To be on the ballot for president in Missouri, candidates would have to prove they are citizens, according to a bill heard today in the House Elections Committee.

Freshman Rep. Lyle Rowland, R-Cedar Creek, is sponsoring the bill, which is co-sponsored by 15 of his GOP colleagues including House Speaker Pro-Tem Shane Schoeller of Willard.

“At the federal level, there is no one checking the qualifications,” Rowland said. “Even though it is in the Constitution, no one is checking those references.”

Witnesses who testified in favor of the bill made it clear the bill is aimed at President Barack Obama, who was born in Hawaii.

“It does close an important loophole,” said Mitch Hubbard of Fulton, who was the Republican nominee for Missouri secretary of state in 2008. “Our military needs to know that their commander in chief is qualified. We have officers in the military who question whether their commander in chief is eligible” to be president.

Obama has a Kenyan father and an American mother and was born in Hawaii on Aug. 4, 1961. But before his election and since, numerous websites and a few lawsuits have questioned his truthfulness and the validity of documents issued by Hawaii that show his date and place of birth. The U.S. Constitution requires that presidents be at least 35 years old and born in the United States.

According to a survey released Feb. 15 by the North Carolina firm Public Policy Polling, 51 percent of likely Republican primary voters believe Obama was not born in the United States, while only 28 percent believe he was.

The U.S. Supreme Court has rejected all attempts to bring a case challenging Obama’s citizenship, most recently in November when it refused to hear a case brought by an Ohio man.

The bill would require anyone seeking a spot on the Missouri presidential primary ballot and anyone nominated by a national party for the general election to prove their identity and citizenship.

Rep. Joe Fallert, D-Ste. Genevieve, asked Rowland how many past candidates would not have met the requirement. “I have no way of knowing that,” he replied.

“If nobody has ever been disqualified under federal law, why do we have to double-check?” Fallert asked. “It is like a solution looking for a problem.”

After the hearing, Rowland said he is not sure Obama is legally qualified to be president.

“I don’t know, but I would like to know,” Rowland said. “I would like to see the records.”

And Darin Chappell, who described himself to the committee as a political science instructor at Missouri State University, said after the hearing that he would need to personally see the official documents to be convinced Obama is qualified.

Chappell said in an interview that he is not currently working for MSU and that he is hired on a per-course basis to teach there. “I have seen no evidence to suggest” Obama “would not be qualified. There has been no evidence submitted either way. I don’t have any way of being able to know one way or the other,” he said.

Committee Chairman Rep. Tony Dugger, R-Hartville, said he intended to push the bill to the House floor, perhaps as part of a bill changing the date of Missouri’s presidential primary. Dugger’s bill changing the primary date to a month later so Missouri’s national convention delegates would be seated was heard right before Rowland’s measure.

The committee did not vote on either bill.

I agree with you - but don't put the cart before the horse. This has never been determined by SCOTUS.

Article II, Section I specifies a "natural born citizen". The 14th Amendment specifies "citizen". The question is whether the citizenship specified in Article II, Section I is the same as that specified in the 14th Amendment when the person has dual nationality.

According to long standing tradition in the United States, "It is emphatically the province and duty of the judicial department to say what the law is ..." [Marbury v. Madison].

As yet, SCOTUS has not ruled on it.

The birth certificate is required to meet the citizenship standards in the 14th Amendment and WKA. This is the first step.

Peregrine Obama fails both due to his transient alien father.

A President must be a citizen and a natural born Citizen.

Obama cannot prove he is a citizen. We have all the documented information required on this forum to show he is not a citizen.

We have the necessary information to show he is not a NBC.

Many concerned citizens read our threads..slowly the information is getting out there..regardless of the abundant trolls.

Excellent! Three cheers for states' rights and those courageous enough to stand up for them!

There are several ways to resolve the eligibility issue and it's encouraging that this way is being used.

It's a serious concern for many and being called a 'birther' isn't going to make that concern go away.

It makes me question the sincerity and scholarship of those who call me a 'birther' not to mention their gullibility and blind faith in the media and the PTB.

Some congresscritter needs to slip an amendment into some legislation that’ll prevent any elected public official - or candidate for office - from sealing any of their personal records (after the age of 18) from a FOIA request. They run for office on the public trust to represent us in our nation’s capitol and we (each and all) have a right to know if they’re worthy of that trust.

Unseal it all! For 0bama and everyone else.

The easiest approach is for states to only allow candidates on the ballot that have been cleared as eligible by there home state. This is a reasonable thing since ‘Citizen’ in Article is a proper noun and refers specifically to a Citizen of one of the United States.

If that had happened in 2008....

Well, since Hawaii did not certify Obama as a valid candidate and certify him to be Constitutionally eligible then he would not have been on the ballot in any state. No one in Hawaii has every certified Obama as constitutionally eligible - no one.

That’s not what the previous Republican administration of Hawai’i Governor Linda Lingle said.
Hawaii was the state that gave Barack Hussein Obama II the largest share of the popular vote.

Also, previously, in August of 2008, the former Democrat Party of Hawaii’s chairman, Brian Schatz, who now serves as Hawaii’s lieutenant governor, then refused to certify Obama’s constitutional eligibility for submission to the Hawaiian Elections Office for inclusion on the 2008 Hawaiian presidential ballot because he was either not able to locate originally documented proof that Obama is constitutionally eligible to serve as president, or he was provided with an original record of Obama’s birth which confirmatively proves he is not eligible to be president.

Really? Are you sure? Have there been DNA tests? Have you seen the long form birth certificate? This is all heresay as far as I know.

Of course his "truthfulness" and the validity of the document is being challenged. In fact it has been found to be an outright forgery. The valid long form birth certificate has not been released.

No Rudi, that is NOT what the Constitution requires. It requires not only that they be at least 35 y/o and a resident within the United States for fourteen years, they must be a NATURAL BORN CITIZEN -- which is different than simply being born in the United States.

Stop the lies! The only two documents that I know of are his application to the school in Indonesia listing him as a muslim named Barry Soetoro and a citizen of Indonesia, and the forged certification of live birth.

I believe that Obama is a liar and a fraud.

Still, I believe it is going to be very difficult for even one state to pass such a long form birth certificate bill before the 2011 presidential elections. Too much controversy surrounding such a bill will cause state legislators to back off.

However, if we could just get one state---that first state--- to have the courage to take that first step for the good of the American people, it would be a tremendous historical event.

Yes, if we could just get one state to take that first giant historical step---just one state---I see another state quickly following that state's example, and then another state and then another state, until there will be a roaring public outcry for all states to require ALL presidential candidates---especially those born in a hospital---to attach a copy of their long form United States birth certificate to their application forms.

NOTE: As for those presidential candidates born in a log cabin or in a taxicab or in the woods somewhere, they should be required to attach an OFFICIAL document from their birth states---one with the state's SEAL--- that they indeed were born in that state on a certain date and with the names of their parents on it.

Yes, all we need is that first state and all hell will break loose.

Obama will read a courtest copy of the St. Louis Newspaper on Wednesday morning and he will definitely leave a mark in his shorts! seme thing with Atlanta Newspaper he will receive that paper as a cortesy and it will leave yet another mark on another clean pair of BVDs Hanes or whatever he is wearing. Just wait on March 4, 2011 when the Supremes have the conference regarding his (soetoro) eligibility as Us president, wonder if the Supremes will get a courtesy copy too. If not any FRs in Georgia and Missouri wish to send a copy to Justice Roberts marked Urgent confidentail essential to the Barry soetoro Eligibility Conference. who knows maybe even the National Enquirer and the Globe might get involved. You know that is the paper Obama/soetoro reads for his news information. Everyone else (NY Times and washington Compost) is slamming him left and right

Ms. Lingle is not the Chairperson the Hawaiian Democratic Party is she. She did not certify squat and did not need to.

Brian Schatz is the guy. He knows. And he refused to step over that line.

The question is. Did he step over another line when he submitted a legally invalid OCON? What he trying to trick the CEO? Was he trying to commit fraud?

Quit hiding behind Lingle’s skirt. Maybe you can hide behind Schatz gonads. To do what he did they must be big.

Newspapers and other media bend over backwards to say “allegedly” about everything regardless of evidence, but they affirmatively say “he was born in Hawaii” like it is some scientific law.

They need to awaken from their illusion. The media has been consumed with lotus cakes.

House Bill No. 283

4 whichever is later, the state committee of each established political party shall certify in writing to the secretary of state the names of its nominees for president and vice president of the United
5 States. Such certification shall include proof of identity and proof of United States
6 citizenship for each nominee.

Yawn!! Does anybody dispute that Obama is a bonafide U.S. citizen? The issue at matter is whether he is a Natural Born Citizen.

Rep. Rowland would appear to be uninformed on the matter based on this bill.
