An employee at a Subway restaurant in northeast Charlotte who shot and killed a robbery suspect in January will not face charges.
Mecklenburg County District Attorney Andrew Murray said Charlotte-Mecklenburg police consulted with his office about the decision.
"We agreed with their decision not to charge because we do not believe a jury would find the use of deadly force was not justified," he said Wednesday.
On Jan. 17 around 7 p.m., two men armed with handguns entered the Subway restaurant on Sugar Creek Road near the Hidden Valley neighborhood.
They were trying to rob the restaurant, police said, and an altercation began when the employee refused to comply with the suspects' demands. The employee opened fire, shooting both men.

Which makes me think that what they're really saying is "we'd like to charge them but we'd look like fools".

Huzzah to that, especially the case of the pizza delivery guy. Back in college, I knew a guy (friend of a friend) who was murdered by a couple of local dirtbags who set him up on a delivery. Poor kid was a year from graduating, and the perps had rap sheets dating back to their pre-teen years. What a waste.
So now, anytime a perp takes the dirtnap instead of a would-be victim, I call it a good day and sleep just a little better.

They had to both judge shop and violate the laws on double jepardy to finaly get a conviction on Bernard Goetz years ago. It cost hundreds of thousands. Lefty prosecuters just don’t have the funds to pull that crap off right now.
Exactly. I think they’re betraying the fact that they are disappointed that prosecution is not a viable possibility. They would LOVE to prosecute.
I imagine that stories like this where a gun has saved lives are all over the media.

It sounds like the prosecutors wanted to charge the subway employee but were afraid of losing the case.
Look for some slimeball attorney to file a wrongful death civil suite against subway on behalf of the families. Jamal and Demetrius will be portrayed as good boys who were victims.
