A cinema manager was not being racist when he told a largely black audience to silence their cell phones and be quiet, Delaware's Supreme Court has ruled.
The court has overturned a judgment by the state's Human Relations Commission that 23 black cinema goers should each be awarded $1,500 for being told to be quiet by David Stewart.
Carmike 14 Theatre, in Dover, was told to make the payouts after 'insulting, humiliating and demeaning' patrons during a showing of the Tyler Perry movie Why Did I Get Married? in October 2007.
The movie theatre was sold-out and was showing the film on three different screens at the same time.
Mr Stewart, who is white, made the plea to keep the noise down before the screening in the main, largest theatre.
He was then followed out of the theatre by a patron, who told him his comments did not go down well.
Mr Stewart went back, explained that he didn't mean to offend anyone, but he had to make the announcement per the policy of the owner, Carmike Cinemas.
Juana Fuentes-Bowles, the director of Delawares Human Relations Division at the time, was in the audience and stood up and told the crowd that his remarks were racist.

The movie house management should have the capability of pausing the film at any time and flashing a QUIET! message on the screen. Then nobody can complain about being singled out.
This is precisely why I REFUSE to ever patronize the Newport Cinema theaters in Jersey City. People bring their little children into Rated-R movies, and seem to have no problem with blabbing on their cellphones, and screaming at the screen as well. Once, my old roommate politely asked a woman to keep quiet so he could enjoy the show. Instead he was met with a half an hour of heckles such as: “YOU STFU, Motha f’a!, I hatechu! I hatechu!” My mother will not even step foot in that mall anymore because the last time we went to the theater it was so loud that she demanded her money back.

I haven’t been to a theater in years. Perfectly fine to wait for the very small number of things I’d even care to see, to get to DVD and watch them at home.
That's the typical demeanor of that demographic. The last one that called me a MF ended up with a face full of pepperspray.
Good thing the award was overturned, before 15,000 blacks claimed they were in the audience that night.

This lunacy puts me in mind of the Calgary Human Rights Commission pursuit of various columnists for telling the truth about Muslims. Too bad we have that same silliness here.
The poor misguided and ill-informed judge simply doesn’t realize that, in the modern era, whenever a White person so much as breathes in the presence of a Black, it’s due to racism.
And so, of course, to be compensated in dollars.

Totally true. I went to a theater in a predominantly black area of Baltimore when I was in college. The audience was 95% black in my estimation. I had never been to a movie where people were literally yelling at the screen. Pssst... it’s a movie, the actors on screen can’t hear you. But the audience sure did. Makes for a miserable movie-going experience.
Thanks rightwingintelligentsia. Obama will of course condemn this judgment during his next State of the Union.
