A federal appeals court on Thursday overturned the acquittal of a Libyan man and two associates who were accused of conspiring to dupe the U.S. government into granting tax-exempt status to a defunct Muslim charity by hiding its pro-jihad activities.
The appeals court reinstated the jurys guilty verdict against Libyas Emadeddin Muntasser together with Samir Al-Monla and Muhammed Mubayyid. The three founded and led the defunct Boston-based Care International Inc.
The organization described its mission as helping war orphans, widows and refugees in Muslim nations. But prosecutors argued that it was a successor to a U.S. branch of a group founded by Osama bin Laden to recruit, fund and transport Muslim militants involved in armed conflicts around the world. The group also distributed a newsletter and published a website promoting jihad and supported extremists.

"The mosques are our barracks, the domes our helmets,
the minarets our bayonets and the faithful our soldiers."
Infidels: freepmail me if you want on or off this list.
To the bottom of the sea with Oswami.
But let’s keep building more mosques in America. We have to be tolerant - even if they use them to plan to kill us.
So how does an acquittal get overturned? I thought acquittals were final in our system. That seems ominous.
ALL 126 people indicted for being terrorists in the last two years were Muslim. Not one was a Tea Party member. Not one was Christian. Not one was an upper-class white woman ( homeland security PSA), not one was a white middle class middle aged male.
Every person indicted for terrorism in the last two years was Muslim.
The jury found them guilty, an appeals court overturned the jury verdict, and this court reinstated the jury verdict. The journalism major who wrote this probably doesn't know what the word "acquittal" means.
Now it makes sense.
The government can appeal on JNOVs, which I assume occured in the earlier trial.
BUMP!
As I read it in the link, the jury found them guilty, and the judge threw out that conviction as “not proven by the evidence”. Both defendants and prosecutors appealed the case, and the appellant court reinstated the jury conviction and sent it back for sentencing. They noted that the jury had asked several “incisive questions” during their deliberations indicating they were actively drilling down through the various claims, therefor the judge was outside of his authority to reverse the juries finding.
The article says a Federal judge overturned the jury verdict. Was it the trial judge or an appeals judge? Usually appeals are multiple judges not an individual.
Would be nice to know the name of the judge. Muntasser is also a Democrat donor.
