The practice of making duplicate claims from asbestos tort and trust systems was hammered by Rep. Trent Franks (R-Ariz.) during a House subcommittee hearing Friday.
Franks said that asbestos litigation has long been - and continues to be - rife with deception and exploitation, negatively effecting asbestos victims, the legal system and the employment of American workers.
He noted that it has been five years since Congress provided oversight of asbestos litigation. At the time, widespread fraud in mass asbestos screenings was uncovered.
"This massive fraud turned the worst occupational health disaster in U.S. history into one of the country's greatest scandals," Franks said. "Yet despite this...legal observers report that the worst abuses of the tort system continue ....

It looks like Doug the Mesothelioma Guy could be out of work.
An asbestos injury coverage system that can’t kick out duplicate claims... and/or maybe people are putting in to it under multiple aliases.
Seems almost nobody’s afraid of cheating the system any more.
I also hear where companies that never made anything out of asbestos are getting dinged, sometimes hundreds of times, giving them headaches of legal fees if nothing more.
Why not Pigford I and II.... fraud and abuse?...
That’s being handled by the 2nd generation of asbestos lawyers, or maybe it’s the 3rd generation...
How do you spend 3 trillions dollars with not one positive result?..

Well is the issue whether or not asbestos caused Lung cancer? I think not, just ask my best buddy....oh that’s right he is dead from Mesothemialoma at age 52. He worked five years at a gas station helping with break jobs in the 70’s/80’s. Don’t think I’m not scared $hitless as I did the same for three years. Now, is it rife with fraud?...probably. When 3000 or less cases are diagnosed a year and yet you can’t go a day without hearing a “LAWYER” commercial in So. Cal for Asbestos litigation......something is up.

Don’t laugh. One of my former co-workers died not long ago after a 10 year battle with mesothelioma. He worked as a janitor in a power plant before asbestos protection equipment was required.
I read Dixy Lee Ray’s “Environmental Overkill” a number of years ago. I’m pretty skeptical about the asbestos hysteria. Especially when “lawyers” are out there making a killing selling the dangers of being around it. Black asbestos, okay. I’d stay away from that.
Mesothelioma is a very nasty way to die. My father worked many years with asbestos flour. As I type this he is in the next room gasping for every breath. He was diagnosed 18 months ago and I doubt he will be with me next month.
It’s Mesothelioma....my husband died of it 7 years ago, leaving me with my 15 year old and 6 year old daughters to raise alone. And I think they are referring to somebody getting Meso that didn’t actually work on a job site...you referred to it as “second hand.” An example being, middle age woman came down with Meso, she had never work around Asbestos, but upon further investigation, it was found out that she used to play hide and seek as a child and she would hide in the laundry basket where her fathers asbestos dust covered work clothes were.
I do believe that asbestos is very dangerous. I also think we need tort reform. If you have a REASONABLE reason to think you have been harmed...by all means you deserve to get a lawyer who DECIDES to take the case on it's merit.
I also think the loser should pay all legal fees.
Just heard that Perry, in Tx did this in some way. THAT IS ENOUGH TO GET ME ON BOARD WITH HIM.
Anyway...my best to you, friend. My husband told me that he used to cook his frozen meals in the asbestos oven at the tire co. he worked at through 4 years of college. Wish he hadn't told me that one.
