Judge: Americans have no right to choose food

A Wisconsin judge has decided – in a fight over families' access to milk from cows they own – that Americans "do not have a fundamental right to consume the milk from their own cow."

The ruling comes from Circuit Court Judge Patrick J. Fiedler in a court fight involving a number of families who owned their own cows, but boarded them on a single farm.

The judge said that's a "dairy farm" and is subject to the rules and regulations of the state of Wisconsin.

"It's always a surprise when a judge says you don't have the fundamental right to consume the foods of your choice," said Pete Kennedy, president of the Farm-to-Consumer Legal Defense Fund, which worked on the case on behalf of the farmers and the owners of the milk-producing cows.

Obama’s food control measures have been undertaken as part of a “global economy” effort to bring third world countries up to Western standards in sanitary food preparations.

The US can’t demand China stop growing fish in sh!t and bringing it into the US without global trade standards with globally uniform health requirements for food preparation. In other words, under the current trade structure, we can’t ban China’s fish grown in sh!t without it being named an illegal global trade practice.

Americans lose freedom to global food regulation so we can fit into the elite’s international regulation because the Chinese don’t know to grow fish in clean water and the Mexicans don’t know not to crap in the fields they are picking.

Just like the Soviet Union ! I wonder what is with some people who have this kind of attitude where you should not be allowed to do anything without approval from some kind of authority. I have dealt with those kind of people and many of them are in the leftists camp. One was a manager I use to work for and we butted heads. Want to take vacation, you have to get permission to take vacation AND get permission to leave town and you better leave you itinerary with him as well ! My response is I would e-mail it to him but the e-mail would never go out !

I’m pretty sure it is, Mama T. All that’s lacking is that first shot... from them, as we fully intend there be NO Fort Sumters to give fedgov even the ILLUSION of a moral “high ground.” And I believe it’s in the pipeline even as we speak, unfortunately. We don’t WANT it, but if they mean to start it, patriots MUST finish it and restore our Constitution to its rightful place!

These farmers should take all the milk they can get their hands on and dump it on the courthouse steps daily while chanting for impeachment of this so called judge. Don’t stop until he is forced out.

They'd be busted for polluting. Google "Milk hazmat".

It's too late for this country.

This judge is very very right on the Constitutional principle you cite.

The right to regulate dairy farms in Wisconsin is not an enumerated power delegated to the United States but one reserved to the States or the people.

This federal judge is finding there is no federal power or individual right that supersedes the power of Wisconsin to pass laws (correct or not) that regulate diary farms in Wisconsin.

If you can get Vol I of Political Sermons of the American Founding era 1730-1805 Ellis Sandoz Editor Liberty Fund 1998 pp627-656 a Sermon preached by Samuel Cooper On the Day of the Commencement of the Constitution Boston 1780. See p639 ‘ “It is to the dishonor of human nature that Liberty wherever it has been planted and flourished has commonly been required to be watered with blood.” If one reads the entire sermon how Jefferson came to word it as he did will be clear. — compare to Jefferson letter to William Smith from Paris Nov.13,1787 Library of America Thomas Jefferson Writings 16th printing Merrill D Peterson editor pp910-912 see p.911 I believe he was making clear bridge by alluding to this Sermon in his letter .And I am convinced form reading his letter Jefferson as usual has been much abused by people too busy -or too distracted to read what he said in context.

I appreciate you sending me this inf. I will dig into this deeper. I believe that I have heard of Samuel Cooper as well. If I’m not mistaken, he is said to have had an extremely powerful voice that would project out to some seriously large crowds that some people today would think that a sound system would be required to reach.

The judge did not say people have no right to own or use their property.

The plaintiff in the case was running a dairy farm and was selling raw milk. If my brief read of the decision is correct, the law allows limited sales of raw milk. So, the plaintiff came up with a scheme to try and get around the law, but eventually they got caught.

The plaintiff tried to say that the law was unconstitutional because they had a right to use their own property in any way they see fit. The judge said their legal argument was without merit since the plaintiff was operating a dairy farm and therefore subject to the rules and regs applied to all farms.

That isn't quite what the case was made out to be.

So - if one party has cows that produces raw milk and another desires to buy it (and accept whatever risk there might be), does the state have the right to deny this?
