Justice Sonia Sotomayor's Shocking Ignorance

The liberal Supreme Court justices have demonstrated profound and shocking ignorance of the American health care system. Here's one of the most jarring examples:

"What percentage of the American people who took their son or daughter to an emergency room and that child was turned away because the parent didn't have insurance," asked Sotomayor, "... do you think there's a large percentage of the American population that would stand for the death of that child -- (who) had an allergic reaction and a simple shot would have saved the child?"

I have a precise answer for Justice Sonia Sotomayor.

The percentage of American people who took their son or daughter to an emergency room and were turned away because the parent didn't have insurance is exactly zero.

No person, whether American or not, is ever turned away from an emergency room for lack of health insurance. Ever.

This simply does not happen.

Here's why:

1. It's illegal.

Emergency Medical Treatment and Active Labor Act (EMTALA) is a U.S. Act of Congress passed in 1986 as part of the Consolidated Omnibus Budget Reconciliation Act (COBRA). It requires hospitals to provide care to anyone needing emergency healthcare treatment regardless of citizenship, legal status or ability to pay. There are no reimbursement provisions. Participating hospitals may only transfer or discharge patients needing emergency treatment under their own informed consent, after stabilization, or when their condition requires transfer to a hospital better equipped to administer the treatment.

You can thank Republican President Ronald Reagan for that, for better or for worse.

We have to vote Obama out of office this year. If he wins a second term, he’ll appoint more justices like this to the Supreme Court.

It appears that this was an actual questions from the Smart Latina during last weeks arguments before the court.

It would be interesting to hear the answer she was given.

Oh, but they have ways to get around their own ignorance; they know that if the rest of society is just as dumb as they are, they will never have to explain their ignorance... and that by conjuring up a retarded form of hypothetical anecdote that pulls at the heart strings, then they get a pass and can infect the rest of us with the poison that will finish off America.

I heard once that the old definition of "Political Science" was basically answering the question: "What should politicians do?" That is -- given the economic and social reality, given the historical record of a community, what should politicians feel is the responsible path upon which the society should be guided? I think that goes back to Aristotle.

Today, "Political Science" is all about the question: "What can politicians get away with?" That is -- with influence peddling and corruption, with cronies in the right place, what can Elitests manage to cram down our throats while still staying out of jail? We make note of Blagojivich who ultimately played the game wrong, but most politicians today are like Ted Kennedy, Bill Clinton, and Barack Obama -- people who know how to get away with ####.

Liberals possess rhetorical skills of which conservatives are incapable. They can simultaneously assert AND believe that:
  1. 'Innocents die when they are turned away from emergency rooms for the lack of ability to pay' and
  2. hold that 'socialized medicine will save money because hospitals won't be performing routine medical care in emergency rooms.'

Thhe advantage of this doublethink capability is simple: situationally-subjective truths are a way to power, for them. They know it isn't true, but as long as we compromise they gain. At that point, objective truth does not matter but is (to them) a form of anachronistic foolishness. That is why they think we are stupid. In a way, they are correct.
