More Regulations: NJ Drivers Can Be Ticketed $1,000 for Not ‘Restraining’ Animals in the Car

Following on the heels of Mayor Bloomberg’s ban on certain sugary drinks in New York City restaurants, a wave of absurd regulations has seemingly begun emanating outwards. In neighboring New Jersey, drivers can be fined up to $1000 for driving with “unrestrained” animals in the car, and the Mayor of Berkeley, California is looking to ban sitting on sidewalks.

According to CBS in Philadelphia, police and animal control officers will be authorized to ticket New Jersey drivers between $250 and $1,000 if they have “unrestrained” animals in the front seat of their car, on the driver’s lap, partially out the window, or even in the back of a pickup truck.

Dogs, apparently, should be placed in harnesses and then buckled in, and cats should go in a carrier which can be subsequently buckled in.

Ray Martinez, the head of the New Jersey Motor Vehicle Commission, says it is part of a larger “Click It or Ticket” effort to avoid distracted driving.

“It’s not cute,” he condemned. “It’s actually dangerous for the driver. It’s dangerous for other drivers and it’s dangerous for that pet.”

According to the New Jersey Newsroom, the regulation actually falls under the parameters of animal cruelty, and the fine can be coupled with a six month term in jail and a disorderly persons offense.

Col. Frank Rizzo, police superintendent for the New Jersey Society for the Prevention of Animal Cruelty, further clarified that the fine occurs for each “offense.”

“So, if you have more than one animal loose in your car, just do the math…” he said.

WTXF-TV interviewed New Jersey residents, most of whom were sympathetic with the regulation:

When our cats travel with us, they usually curl up under the driver's seat. No distractions. However, I think I'll stay out of NJ just in case.

A few drops of Super Glue usually keeps them securely fixed to the dash board. (Before you ping the Slings and Arrows... it is a JOKE. LOL!)

I’ll probably get slammed for this...but as someone who drives a LOT...it’s very annoying to see people driving around with dogs on their laps. C’mon, really? You need to drive around w/ a dog on your lap? And people who drive on the freaking highway at 70-80 MPG with their dogs in the back of the open pickup bed. That just is wrong IMO. It is not safe for the animal or the rest of us out driving around at the same time. Kind of like those idiots who text while driving.

Hey, you can do anything you want on your property. But if you’re going to go out on public roads driving...I think you should be paying attention to the dang road and other vehicles and not texting, shaving, putting on mascara or having some little (or big) dog taking your attention away from your real responsibility. You know...driving a heavy metal object that requires some attention to freaking details. (say other cars)

Done w/ rant. Putting on flame resistant suit and ducking.

So...the Back-Seat unrestrained is OK then? What's partially out a window? The muzzle? A Paw? The whole head? If a tail is outside the window wagging - is there a fine with that too?

So...even if your cat is in a carrier - and it's NOT buckled in they can still fine you?

How many people thought when they put seatbelt laws in effect with fines that it would get to pets too? Pretty soon we'll need to buy restraints for the drink holder compartments - and if we don't we'll get fined.

Getting mighty ticked-off at these slippery slopes.

Whatever. It’s a joke and nobody cares.

I saw 3 pooches unrestrained in cars on the way home today in the DPRNJ.

There was no SWAT team asking the offender to come out with their paws up.
