Kagan had to recuse herself since she helped the administration fight S.B 1070 as Solicitor General prior to her nomination.

Based on the CFR result I am not optimistic on any of them

Amazingly enough. The Supreme Court has 5 Justices that were chosen by Republican President and only 3 by Democrats. We should be winning everything that is for the Constitution but unfortunately our Republican Presidents are just as bad if not worse than the Democratic Presidents when picking Justices.
