-- A Democratic “congressional official” talking to the Associated Press about plans in the Obama administration to proceed with the president’s 2010 health law even if the Supreme Court strikes down its central provision requiring all Americans to either purchase insurance or be enrolled in a government program.

The looming Supreme Court decision on President Obama’s 2010 health law has Washington in a state of high anxiety.

Hopefully, all Americans will stand behind the Supreme Court's interpretation of the law and the US Constitution....If we are not governed by law, what will we become?

The King has plenty of precedent for acting on his own - he has done it over and over - ignoring courts and the Congress.

My bet is that when (and if) SCOTUS strikes down Obamacare or parts of it, he will just ignore it and carry on with implementation as fast as possible. I ASK YOU HERE ON THIS FORUM WHO IS GOING TO STOP HIM??

November 2nd was election day during the 2010 mid-term elections.

The presidential election in Nov. 2008 was Nov. 4th....
the presidential election this year will be on Nov. 6th

The individual mandate (IM) was always a head fake, a red herring.

Obama never cared for the IM, his people wanted a massive tax increase from the beginning but they could not package the legislation as a tax increase.

In Title IX of the Act there are Revenue provisions. These are taxes on incomes and taxes on Employer Sponsored health Plans (ESHPs), as well as myriad other taxes.

The taxes on ESHPs are 40% above a certain value. The ‘value’ is determined by the government and the level is arbitrary. IOW the fed government has the power to force employers to abandon ESHPs.

The taxes on incomes are small and apply to incomes > 200k but these taxes will grow as they always do.

Severability was not included because to have done so would have invited an analysis of whether the plan would work with severability and they were touting the IM was essential which it is not because the taxes in Title IX can be expanded and amended at midnight until they have the massive tax and control that they were after.

This is a poker game and the dems are good at it.

Pelosi said we would have to read the Bill to see what was in it. Well we have and we know it’s a massive tax increase to be rolled out in the next 5 years.

And the awful reality is that Romney if elected will follow through with the tax provisions of Obamacare and he will increase them.

It’s been known since 1996 and before that the USA has to raise tax rates to 86% to meet entitlement obligations. Nearly all legislation coming out now is driven by NWO persons to avoid the US insolvency by cleverly passing tax increases. This is the motivation behind Obamacare, not anything to do with health care.

If the mandate is struck down, then the insurance companies have no mechanism by which to "spread" the costs to younger, healthier policy holders. Premiums would "necessarily skyrocket". It doesn't matter whether severability is allowed or not.

So the worst thing Obama and the Dems could do would be to forge ahead. It would be political suicide. Insurance companies would be ok in keeping youngsters on Mom and Dad's policies until age 26. They would not be ok with being mandated to cover pre-existing conditions. Policy holders will definitely not like the latter, and that's where votes are.

If the individual mandate is struck down, we win.

The Obama adminstration will attempt to cajole, shame, and bribe state governments into adopting a state mandate, which will still be constitutional. This has a political upside for Obama, in that he’s running against Romney.

If the mandate fails, but all else remains in place, we will end up with socialized care anyway. Because there will no longer be any private insurance left.
