CENTERVILLE — Sandwiched between a pair of cellphone providers and just a few rows of parking away from a pancake house, a tenant at the Centerville Marketplace advertises "cigars, hookah, gifts and more" on a storefront sign.
City leaders and law enforcement officials say the Smoke Shop at 356 N. Marketplace Drive is out of place, and they want to prevent other tobacco retailers from setting up shop in the city.
"It's been a continuous problem for our police department," City Manager Steve Thacker said of Centerville's lone smoke shop.
The city is considering an all-out ban on tobacco retailers, which would be the first of its kind in Utah, but likely not the last. Municipalities throughout the state are working to revise zoning for such establishments to comply with a new state law that went into effect July 1.
A bill passed during the 2012 Legislature and signed by Gov. Gary Herbert in March requires businesses that want to primarily sell tobacco or smoking paraphernalia to obtain a "tobacco specialty business license," which sets standards for where and how they can operate.

I suppose that the smoke shops were just asking for government intrusion when they break the law constantly. I wish they would have just complied and slipped back into the cultural shadows. I still don't think that the conservatives of this state understand the small government portion of being a conservative.

I would tend to agree. The problem is its more than just this city, the state has made a change to where smoke shops can be located. It appears to be a complicated change that makes tobacco more regulated than many aspects regarding alcohol.
Those of us in Utah that are not Mormon get a bit sensitive about the legality of being an adult. The LDS church has such a stranglehold on our government that it barely gets to come up from the baptismal water for a breath.
If this smoke shop broke the law then shut them down, arrest the owner, then throw him in jail. If not then I don’t think that the perception that patrons of a smoke shop are “not the best people” is reason enough to shut them down. I don’t think that Represenative Paul Ray is a good person although I am sure he thinks he is. I mean good in the biblical sense.

Indeed! In November, 2008, a group of conservatives met for a cigar party at a tobacco shop in Rancho Santa Margarita, Calif. The man who organized the group now serves on the city council.

Their approach is wrong. When you have a dozen different people spit-balling how to exclude a business, and saying so, it almost guarantees that the courts will find those actions to be unlawful. It is called “telegraphing” your intentions.
Instead, being careful not to break any public meetings laws, you do your planning quietly and speak with one voice, through a single spokesman, using some technique that has been proven to work elsewhere.
Judges are often amenable to such exclusions, as long as they are not blatant and are presented in an orderly fashion.
