The Environmental Protection Agency (EPA) delivered a blow to the petroleum industry Monday by denying a petition that would have exempted refiners from part of a biofuel blending mandate, according to documents obtained by The Hill. EPA shot down the American Petroleum Institutes (API) challenge of the renewable fuel standard (RFS), according to Monday court filings with the U.S. Court of Appeals for the District of Columbia. EPA determined that enough advanced biofuels generally understood to be made from non-food products existed to meet that portion of the RFS for 2012.

The EPA is only one of a number of government agencies and departments I’d axe if I had the opportunity.
What one EO can impose, another EO can eliminate. I expect Romney will go through and wipe out all of his midnight regulations. In fact, I hope he makes it clear that is his intention.
Actually, I agree with Ron Paul. ALL EOs should be eliminated. If laws are needed, that is what Congress is for. I have never liked EOs.
Protecting the “cellulosic ethanol industry” which exists ONLY because the fed govt has mandated that it should exist. Science and economics has proven time and again that it should remain on the shelf.
This decision is one government agency (EPA) protecting (taxpayer confiscated) funding for the DOE and USDA.

The federal government has SUCH a stellar record of picking winners and losers. Actually, it actively crushes winners to highlight losers. The cellulosic biofuels industry was expanded to provide the USDA something to do in light of its declining relevance.
Isn’t whale oil a biofuel? Can we get subsidies to bring it back?

Actually, it only exists in the mind of the federal government, no where in reality even with the mandate.
If you think the government penalizing or is it taxing? people for not buying health insurance is bad, at least there are health insurance companies actually selling coverage. By contrast, the Environmental Protection Agency (EPA) fined oil refiners $6.8 million last year for not incorporating cellulosic ethanol in gasoline even though the product doesnt exist.
