U.S. military court removes judge in Fort Hood massacre case

The top U.S. military appellate court on Monday ruled that the judge presiding over the case of an Army major charged with a 2009 massacre at Fort Hood, Texas is not impartial and ordered him removed. The court also set aside the order by the judge, Colonel Gregory Gross, that accused gunman Major Nidal Hasan be forcibly shaved. The action by the United States Court of Appeals for the Armed Forces further delays the trial of Hasan, 42 (snip)

Being of sufficient age, I am reminded of the almost endless delays engendered by the North Vietnamese concerning the shape of the table at the Paris Peace Talks. Absolutely nothing to do with the actual issue, just a method of tantrum and control.

Same here, the need to determine guilt is a nonissue, instead we get this Kabuki Theater of the Absurd. Do I think that this Administration had no desire for a trial during the election ... Of course they did! This is just a continuing operation to keep this “Workplace Violence” out of sight and mind.

This massacre took place on November 5, 2009, over three years ago. The murders took place in front of dozens of witnesses. Even the Mayberry police department could have investigated this crime, sat a jury, presented the evidence, and concluded this trial with a guilty verdict in less than a year. I am ashamed of what my military has denigrated into, a politically correct farce led by an illegitimate amateur.

If I’m correct, doesn’t he maintain his pay as a major until he’s convicted? If so, isn’t he still subject to UCMJ? If so, slam him with article 15’s every time they can for violating military grooming stands. It’s a small thing, but drip him of half his pay and demote him every time they do it

You’re absolutely correct. I don’t know his physical capabilities because of his paralysis, but I’m sure he is bathed and fed, he can also be shaved. And if he goes to the courtroom, he is dressed in his military dress uniform. Standard operating procedure.

He does have the right to not elect to receive the Article 15 and ask for a trial in lieu of the Article 15 for each offense.

This murdering scumbag already has a Presidential Pardon.Obama just hasn’t released it yet.

I'm just waiting for the complaining from the Republican Party when that happen.

The gutless wonders have given Obama a really free hand at doing whatever he wishes so far.So they really have nothing to complain about.
