No, he was right. A militia is a type of military.

The use of the term "militia" in the Federalist papers was used to mean a separate and distinct group from the military. Penn and Teller, equated the two without a distinction between them.

This was an error on their part, though I agree with them on this issue. Here is a source for usage of the term as intended by the founding fathers.
