Spokesman: ‘Senator Ted Cruz is a U.S. citizen by birth’

In the past few days, there has been renewed buzz on the Internet about the presidential eligibility of Texas Sen. Ted Cruz. Cruz has only been in the Senate for about 60 days and does not appear to be behind any of the talk. But he has certainly been in the news in recent days, and in response to a request for comment, his spokesman, Sean Rushton, sent me this note:

Sen. Cruz is a U.S. citizen by birth, having been born in Calgary to an American-born mother. He is focused entirely on his new role in the Senate, and on working every day to represent Texas and defend conservative principles in the Senate.

Any talk about Cruz follows years of discussion about birthplace and presidential eligibility involving President Obama, Sen. John McCain, and Sen. Marco Rubio. The bottom line in the case of Cruz, who was born in Canada in 1970, is that his father was an immigrant from Cuba and not a U.S. citizen at the time of young Cruz’s birth, but his mother was born and raised in the United States. The law in effect then, and now, made Ted Cruz a U.S. citizen at birth. Although the drafters of the Constitution did not define what they meant when they required an American president to be a “natural born citizen,” it is generally thought that “citizen by birth” is the best modern-day equivalent. On that basis, Cruz appears entirely eligible — if he ever chooses to pursue the White House.

Ok, I’m reading a lot of the replies with a growing sense of frustration. Most of the opinions being shared here are just that, opinions!

People who truly want to understand the issue will do the research and not only READ what the Constitution says, they will track down the origins of the term “natural born citizen”, understand those origins as well as understanding the various court rulings that have addressed this issue.

I have done extensive research on this topic, including following the paths I have just outlined above. Because I don’t want to be caught in the middle of a pi$$ing contest between birthers and non-birthers, I am not going to offer my understanding of “natural born citizen” based on my research.

If you really want to know what you are talking about, do some research. The information is available.

Yes, but Hamilton’s plan was not adopted. This is what OUR OWN ARTICLE IX says:

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Yes....it seems the same folks who are Obama Supporter and always attacked the Obama Eligibility folks have now seemed to latch on to another scheme to help Obama.....this time claiming foreign born Ted Cruz is eligible to be President.

Our Founding Fathers are grimacing in heaven over this nonsense.

If the Obama Supporter folks think Cruz, Obama, et al....are “eligible”....how will they spin the 2007 Senate Resolution that dealt with John McCain’s eligibility

2014 and 2016 now not looking good for conservatives with the PhonyCons making the same dumb mistakes

Let Senator Cruz represent the Great State of Texas and let God guide his thoughts and provide the wisdom needed to seperate the evil from the good.

May our prayers be with him on his struggle towards the goal of ridding our Constitutional Republic of the Usurpers and Tyrants that are housed within the District of Columbia.

Yeah. I don’t buy it. If the founders just meant citizen they could have said that instead of term “natural born citizen” which to me has to at least mean the person is born in the US.

Apparently, many see no confusion in the framers making a specific requirement that these opiners already have applied to legislators, by their definitions. Poor framers, so prone to redundancy dontchaknow.

Yes.

Can anyone show me an article in the Constitution barring President Bush from being King of Afghanistan in 2004? (assuming he were offered that position?).

Can’t find it there either.

However, political reality is such that it won’t ever happen, unless of course Americans collectively went bananas.

Should Cruz commit a crime that has a punishment element that Canada objects to and he flees to Canada, there is no way they would hand over one of their citizens to the USA.

Not by choice, but by birth yes.

There are two ways to achieve citizenship in the US under English common law, not Napoleonic code law: 1) To born a citizen 2) to seek citizenship under US law.

Since Cruz became a citizen at the time of his birth, he became a “Natural Born Citizen”. Since he has resided in the US for greater than 14 years, he is eligible to be President.

But he is a US citizen, therefore he is under American jurisdiction.

If a US born citizen were to commit a crime and flee to China, and the Chinese like him, there is no way they would hand over the man as well.

You are wrong. Stop spreading ignorance.

Naturalized citizens have paperwork indicating the time and place they were granted citizenship.

Does Cruz have this? No.

Same is true for Obama. His mother's family has been in the US for a long time. He's a born citizen.

Just how it is.

We have never needed this pseudo-legal nonsense to know Obama is anti-American New Left who should never have been elected.
