Kansas Governor Signs ‘The Second Amendment Protection Act’

Tuesday Kansas Gov. Sam Brownback (R) signed what is being called the strictest Second Amendment protection law in the nation. “The Second Amendment Protection Act” does exactly as the name implies: It provides residents protection of their Second Amendment rights by exemption from federal gun control laws, including bans or restrictions on certain guns, magazines or ammunition, for all guns and accessories within the state’s borders.

“Any act, law, treaty, order, rule or regulation of the government of the United States which violates the Second Amendment to the Constitution of the United States is null, void and unenforceable in the state of Kansas.”

Simply put, any federal gun control laws that may be passed are not valid in the state of Kansas under the new law. The bill also prevents any federal agent from enforcing federal gun control laws within the state, as well as allowing prosecution of federal officers who try to enforce such laws within the state’s borders.

In what seems to be a growing trend, there are currently 30 other state legislatures considering similar laws to ensure that the right to keep and bear arms shall not be infringed in their state.

Kansas lawmakers hope the bill will also encourage gun companies who are threatening to leave gun restrictive states to set up shop in Kansas.

Co-sponsor of the Kansas bill, state Rep. Brett Hildabrand (R-Shawnee) told the press, “My understanding is, it is the strictest Second Amendment protection law in the nation. That is really great news. It creates a stark contrast with our neighbors in Colorado. I consider it a pro-job growth bill because of it encouraging the large gun manufacturers or those who make gun components to move to Kansas.”

However, a massive non-compliance of federal gun control laws throughout the states would make it hard for any such laws to be enforced in the first place.

I would also like to see State Law that makes it a fellony for the State Federal representatives from voting for any bill that restricts or limits the 2nd admendment.

This is also outstanding!

Card-carrying Obamanation Journalists have used every excuse that they can spin to enable Tyrant B. Hussein Obama to continue to bypass Congress and destroy the US Constitution.

Our sorry Liberal Agenda Media, has proven to be a willing ally to Commie Obama by publishing gun ownership information in their sorry news outlets.

“Confidential” Gun Show background checklists are as confidential as the weakest link in the confidentiality chain, be it the sorry ‘Freedom of Information Act,’ or a sorry Media outlet Editor.

The purpose of a confidentially armed America Citizenry is THE BEST DETERRENT to power grabs by Tyrants such as the current wannabe Tyrant B. Hussein Obama.

Thus, Government knowledge of private gun ownership is illegal because it is an infringement upon the 2nd Amendment.

Gun background checklists collected will be used to confiscate our anti-Tyrant guns whenever the present or future Tyrant chooses. Of course, that would happen ONLY when it is in “the National Interest.”

_________

We need to stay focused!

DO NOT GET DISTRACTED!

Commie Obama has just begun to fight us!

With Communist-Style Communal Obama’care,’ B. Hussein already has one-sixth of the US Economy under his Communist heel.

Control of the US House in the 2014 National Election will clear the way for Commie Obama to take over the other five-sixth of the US Economy.

Most of the news from the Obamanation Administration centers around topics that are designed to be just another Obamanation Smokescreen to divert the attention away from Obama managing each new Constitutional Crisis into a Regulation that violates the Constitution.

“Never let a Crisis go to waste,” is the rule that guides Commie Obama.

Examples of these Obamanation distractions are most of the social issues that get attention by the Liberal Agenda Media.

Our sorry Congressional RINOs have been to stupid to learn this smoke and mirrors distraction game, and run from bargain to bargain or deal to deal, with nary a thought to use REGULAR ORDER, as designed by our Founding Fathers to protect us from Tyrants such as B. Hussein Obama.

If “bargains” and “deals” do not work then Arrogant, Incompetent, Communist Tyrant B. Hussein Obama will try to bypass the REGULAR ORDER of Congress by using Executive Orders, selective enforcement of REGULATIONS, and other Jack-Booted actions and verbal dictates that are consistent with the Communist Cell training that B. Hussein received in his quest to “FUNDAMENTALLY CHANGE THE UNITED STATES OF AMERICA.”

As any card-carrying Obamanation Journalist will tell you:

” - - - We must support Obama “ - - - TO FUNDAMENTALLY CHANGE THE UNITED STATES OF AMERICA - - - ” into a totally Regulated Communist Obamanation of Debt and Doom.

After all, how else can “- - - everyone get a fair shot?” - - - “

BTW, RECEIVING a “fair shot” would have been a lot easier if Commie Obama had succeeded in his personal recent attempted “bipartisan” destruction of the 2nd Amendment to disarm us - - - - .

We used to be, but not anymore! Conservatives now control the Governorship, Senate, and House in the state of KS. We had a RINO purge in the 2012 primary and won big in November as well! Prior to 2012, the Senate was controlled by Democrats and RINOs who worked together to kill conservative legislation. We also have Kris Kobach as our Secretary of State.

Thank you Obama for opening Kansans eyes to the Democrat party and liberals in general!

Yeah, I see a flaw...

what’s the definition of “Constitutional”?

IE, what’s the Ultimate Authority?

Tried in two states I know of, SD and WY. Failed in both primarily due to the felony portion of the bill. The Legislatures were both put off by that particular portion. Unfortunately, that is the only thing that will add the appropriate teeth to the bill.

That we need laws to PROTECT Constitutional rights shows how far we’ve sunk.

We are talking about what the Founder's referred to as an "inalienable" right. The 2nd Amendment is a restriction on the government and doesn't give the citizenry anything. We need to stop referring to it as a Constitutional right because the Constitution can be amended and opens up an argument for the left.

My guess is that the courts will throw out that part. However the state (ie police) is under no obligation to assist in enforcement of Federal laws. They can pass a law that states that.

Just to be the Devils-U-know-what, if the courts allowed this then Dem states could to this to the Federal partial birth abortion ban law.

Exactly- We’re sunk as a nation- reid correctly said somehting liek hte following today that thsoe opposing it will ‘have to aqueisce at soem point due to shifting view in America’ and that’s just how our constituional rights WILL be violated- because the majority WILL be branwashed into thinking our rights are NOT rights and shoudl be doen away with ‘for the safety of the masses’

We are sinking fast- dear leader pledged that he was goign to destroty htis country- the peopel swooned to his feet kissign htem and drying them with hteir hair, and he will not rest until our constitution is destroyed as well

the reaso nwhy your state went democrat was because of farming- farmers were pwomissed the moon under the democrats- and the left did deliver- but thankfully Kansas has awoken as you said- Sadly though many other farm states are not as awake as your state-

[[Here’s a wild thought, let’s make the Constitution the Supreme Law of the Land!]]

That woudl be fine- but conciderign how the left loves to twist everythign and imply crap thaty isn’t even remotely conencted to what was said, you woudl have to reconstruct the constittution in such a way that it couldn’t be twisted- a tall task indeed conciderign the ivnentiveness of the left

Agreed. It's getting harder and harder now.

I’ve just sent Governor Brownback an e-mail commending his action and urging to hold firm against the inevitable federal pressure to revoke this legislation.
