You are only making a fraudlent withholding claim if you claim such that you owe more taxes at the end of the year that incurs a penalty. I did this back when I had a mortgage to recoup part the interest payment deduction I had at the time. Many people I knew did this too. It isn’t illegal.
As long as you don’t end up not paying all of your tax due, they can’t really say anything and make it stick..
