The Supreme Court ruled in a 5-4 decision Monday that police may take a DNA swab from people arrested for crimes without first getting a warrant to do so. In an unusual twist, the court's conservative firebrand, Antonin Scalia, joined three of his liberal colleagues in a scathing dissent that warns the court's decision paves the way for the creation of an invasive police state.
Scalia called the decision's scope "vast" and "scary," and said the DNA collection is an unequivocal violation of Americans' Fourth Amendment right to be free from "unreasonable searches and seizures" of their bodies and homes.
"Make no mistake about it: As an entirely predictable consequence of todays decision, your DNA can be taken and entered into a national DNA database if you are ever arrested, rightly or wrongly, and for whatever reason," he wrote.

(Scalia) He was supported by Justices Ruth Bader Ginsburg, Sonia Sotomayor, and Elena Kagan. Scalia’s prior support of Fourth Amendment protections is well-documented, so his siding with three more liberal members of the court was not surprising.

There is something terribly wrong with the universe when Antonin Scalia, arguably the most conservative of the Supreme Court justices sides with Ruth Bader Ginsburg, arguably the most liberal.
I don’t mind being fingerprinted. When it comes to the essence of who I am, that’s proprietary information.
Who owns your DNA? You or the government?
Whose to say this sample couldn’t be stored and used as a massive gene pool? Once they have it, they can replicate it and use it without your permission.
Now all you folks who think they’ll just keep a computer file, you’re the same folks that whine when you find out government agencies are misusing your private communications.
Why would you ever sign off to someone other than yourself owning a sample of your DNA?
If someone wants to pay me for an aspect of my DNA, then it’s mine to determine what and how much? If they have a sample for free, what stops them from doing anything they want with it?
Well..., nothing actually. Go ahead, sign off on the Obama administration and it’s flying monkeys having your essence to spread around.

As has been demonstrated amply, the government cannot be trusted. Period. And the framers knew that.
Clear violation of the 4th amendment. More proof that they intend to compile a database of all details about every person in this country and they can be counted upon to use that info to intimidate and enslave all of us.
This is a sugar coated police state. No mistake about it.

That may have had something to do with the allegations that he was the father of a boy by a black hooker in Little Rock.
When I applied for my CCW they cops had to fingerprint me 5 times because they kept screwing it up. Fortunately 5 times was the limit allowed by the law. So despite the fact they screwed up the 5th time they werent allowed to ask me to submit again.
And there is something decidedly bizarre when Ruthie should be sided with. Why are the Marxist members of the court suddenly interested in upholding the Bill of Rights?

LOL! Didn’t now there was a limit to the times they could asked for your fingerprints in a volunteer printing. Did you submit to another try? I guess you did if you got your CCW.
In the near future they’ll be able to sequence your DNA and digitize it. I was at a recent HIPAA conference where they indicated 1 billion people will be sequenced within 10 years.
They’ll know which diseases you are likely to get and a whole host of other things.

There WILL be a national DNA database of everyone - 0bamacare will see to that.
Nope they sent my permit and a notice saying the 5th permit wasn’t readable but they were sending because of the limit.
Ironic since my fingerprints are already on file with the feds via the military.
