Stolen email probe led to kiddie porn charges (NM - Dem union/lib political activist)

The arrest of an Albuquerque political consultant on child pornography charges stemmed from a search warrant served on his home in November by FBI agents looking for evidence in the investigation of the alleged theft of Gov. Susana Martinez’s campaign emails.

The home of Jason Loera, 44, in the 6200 block of St. Joseph’s Court NW, initially was searched on the morning of Nov. 20, 2012, by agents looking to seize Loera’s computers so they could be searched for information about hundreds of emails to Susana2010.com that federal prosecutors allege were illegally intercepted.

FBI computer experts began examining CDs seized along with computers for information about the email theft when they came across explicit examples of child pornography.

Based on what they saw, agents then sought a second search warrant, unsealed Tuesday, to examine the computers, CDs and other material for evidence that Loera had downloaded child pornography.

According to that affidavit, agents sought the second search warrant after they saw downloaded photographs of a girl 6 to 12 years old having sex with an adult male and a photo of two boys between the ages of 6 and 12 having sex.

Loera has been a paid political consultant in New Mexico for the last decade, working on behalf of unions, Democratic Party candidates and progressive organizations, including Grassroots New Mexico PAC.

Other records show Loera was working for Grassroots New Mexico up until the fall of 2012. The political organization has been associated with current state Democratic Party Chairman Sam Bregman.

Feds caught up with him in LA last Friday and arrested him for receiving and possessing child porn. He was released on $20,000 bail, with electronic monitoring.

Please indulge a lengthy post, as many of you have asked me about the recent news of my email theft and I thought I would take time on my flight back to New Mexico to provide you a thorough update.

Last week, an individual I fired from my campaign was indicted in federal court for illegally intercepting my political and personal emails for almost a year that were then released to the media by leftwing political groups last year. The man is also charged with lying to the FBI about the scheme.

A few days later, another man whose computers were seized by the FBI in the email theft investigation was arrested for possession of child pornography. The child pornography was found when the FBI served a search warrant in the email theft investigation, according to news reports. This man was the PAC Manager for the now Chairman of the Democratic Party of New Mexico, Sam Bregman. Bregman was very active in trying to use the emails to attack me.

Some of the stolen emails included things such as bank account information, receipts for clothing, and political strategy memos. Those personal emails were released to be publicized by New Mexico Attorney General and Democratic candidate for Governor Gary King. Afterward, King claimed he had no idea there was an ongoing FBI investigation despite the fact it had been very publicly reported in the media.

In politics, we should expect tough and vigorous debates on the issues. But it’s disgusting to see operatives committing crimes and invading the privacy of their political opponents just to score cheap political points. And it’s almost unbelievable that the state’s chief law enforcement officer interfered with an ongoing federal investigation by releasing emails he had to have known were stolen — and provided to him directly by a union-funded PAC. That shouldn’t happen on either side of the aisle.

Now, the leftwing criminal defense lawyer representing the indicted is promising a smear campaign. I stood up to criminals for 25 years as a prosecutor, I wasn’t intimidated then and I won’t be intimidated now.

I may be missing something here, but it seems to me search warrants have to list exactly what is being searched for.

If child pron wasn't on the list, then they can't use it to prosecute.

I realize that we no longer live under the rule of law, but when we did that's the way it was.

They found the material after the computers were seized for examination related to the stolen emails. As the article said, when they saw the kiddie porn they got a second search warrant for the kiddie porn. In any event, its like investigating a house murder scene and seeing drug paraphernalia on the coffee table in plain sight. You then get a search warrant to search the house for drugs as you have probable cause.

(I’m not a lawyer but stayed at a Holiday Inn Express last night - not!)

I wouldn't be surprised to see some Democratic judge still declare the kiddie porn inadmissible because someone forgot a staple in the search warrant request. This whole thing will be quietly forgotten.

As the article said, when they saw the kiddie porn they got a second search warrant for the kiddie porn.

It's still fruit of the poisonous tree when you piggyback a second warrant on top of a deficient warrant.

But as I said, I fully understand that we no longer live under the rule of law. We now live under the rule of men, and whatever those men find to be most convenient.

The first warrant didn't cover kiddie pron. They went back and got a second warrant after they discovered it under the first warrant.

Going back to get a second warrant is a sham. If they can get a second warrant to cover anything they find that wasn't covered by the first warrant, then the whole purpose of warrants is defeated and you have no fourth amendment rights against unlimited search and seizure.

Although in your mind I am sure there is a kiddie pron exception to the fourth amendment right there in that living document, the US Constitution.

If they find evidence of a serious crime while executing the first search warrant, are they supposed to forget about it? Any lawyers on here sort it out?

Just for ammunition when debating – not devolving into liberalist debate tactics: "But Mo-om, Johnny's parents let him..." – I've compiled a list of Democrat criminals and union thugs / perverts ('teachers' mostly) for further dissemination.
Some formattinga and bold included but I apologize for the document being difficult.

Did the warrant specify what was being sought? The evidence could get thrown out if it wasn’t worded to include porn.
