Sober driver charged with DUI... even though he had a 0.000 blood-alcohol content [AZ]

An Ohio man was charged with DUI after her was pulled over by the police, despite the fact that a breathalyzer test showed he had a blood-alcohol content of 0.000.

64-year-old Jessie Thornton who now lives in Surprise, Arizona said cops told him that they could tell he was drunk simply by looking at him.

Surprise Police Department paperwork shows Thornton was 'pulled over for crossing the white line in his lane.'

'An officer walked up and he said ‘I can tell you’re driving DUI by looking in your eyes.’ I take my glasses off and he says, ‘You’ve got bloodshot eyes.’

Thornton said two other officers arrived and they conducted the sobriety test.

With a BAC of 0.000, the situation should have been resolved quickly, but Thornton was evaluated for possible drug use as well.

'Yes, I do the breathalyzer and it comes back zero, zero, zero,' said Mr Thornton.

While in custody, a 'DRE' or drug recognition expert is called in to test him.

'After he did all the tests, he says, 'I would never have arrested you, you show no signs of impairment.'

'I then get this message that my license is being suspended and I have to take some sort of drinking class or something,' he said.

Mr Thornton now claims that it wasn't DUI but motivated by race.

'It was driving while black,' he proclaimed. 'I just don't want any of this to happen to somebody else,' he said.

His latest incident with Surprise police officers prompted him to hire a lawyer with plans to sue the department for $500,000.

I’ve contended for years that people who just finished a hard/heavy weight training or cardio workout ride a post-workout “high” that can impair driving. I’ve personally experienced this more often than I can count.

Red eyes from swimming in an LA Fitness pool (probably very chlorinated as are most public pools), been stopped 10x for basically nothing, etc.

Just thugcops in action...

That’s why they call this place Surprise!

If there’s no better evidence of DUI than erratic driving, he’ll probably skate in the court, but it does smell like generic harassment. The race card, it has long been maxed out however.

I don’t care what color he is. “We” have created an authoritarian nightmare no matter where a citizen lives or what he drives. Americans want to live in an impossible zero risk environment. Americans demand that any minuscule risk that can be identified be transfered to others. In otherwords Americans DEMAND that personal authority be transfered to strangers in order to save their sorry worthless Gubment cheese addled butts. I hope the dynamic duos of Sharpton and Jackson reign unholy, ridiculous hell on Suprise.

“Hey you look intoxicated” well on what. Hot alcohol, obviously. I suppose they demanded either blood test for other possible intoxicants or forfeiture of license. But if the other possible intoxicants come up clean then the worst a sane prosecution should accuse would be erratic driving (not staying in lane whatever), a petty traffic offense. It’s really unconscionable to throw books at people when there’s no support for most of those books.

Odd... I've played tennis for three hours and noted, while in the car afterward, my respiration was about six and my heart rate about 40. Never felt sleepy or tired but fully relaxed and rested.

I know it sounds weird but it's true.

During allergy season I have both bloodshot eyes and a red nose.

I would be hauled in for DUI and assaulting the officer when I sneezed on him.

I’ve been through that in a hick town in GA just because they didn’t like who I was in the car with. GA law at the time allowed accused to request a blood test. I demanded either a breath or blood test and the fat, stupid, inbred, cretin processing me laughed and said, “Boy, you ain’t getting shit. We can look at you and tell you’re drunk.” Of course I have no race card to play so I eventually just paid the fine. We were with a casual acquaintance we thought was on leave from the Navy. Turned out he was AWOL and wanted as a deserter. Cops felt they had to charge every one in the car with something. My brother and our friend had been drinking but I hadn’t.

A problem I will never have ... I tried working out once, it made my beer slosh out if its can.

Agreed. Sounds like the local police are out of control. Now everyone is going to have to fear DNA mouth swabs when stopped too. I hope he wins.
