IRS fears Disclosure Above All Else, Offer Made in Court Confirms (Jewish Press)

The IRS insists that there is no legal remedy for determining whether an applicant's constitutional rights have been violated, and that offended parties must be satisfied with a "good enough" remedy, even if it is not perfect.

The IRS is doing everything it can to prevent accusers from determining whether its decision making processes violated the constitutional rights of applicants for tax exempt status

On Friday, July 19, in federal district court in Washington, D.C., Department of Justice lawyers who have the misfortune of having to represent the Internal Revenue Service were forced to reveal exactly how desperate the IRS is to keep its deep, dark secrets buried.

The hearing was held to determine whether the IRS would succeed in convincing the court to dismiss Z STREET’s lawsuit for viewpoint discrimination, before any of the claims alleged by Z STREET can be examined.

It is critical for the IRS to succeed at this stage of litigation, because if it does, Z STREET will be barred from finding out whether the IRS acted in an unconstitutional manner in setting aside its application for tax exempt status. If the IRS succeeds at this stage, no questions will be permitted into how it is that, according to documents produced by the IRS, the application for tax exempt status of an organization with a viewpoint about Israel which differs from this administration’s was pulled aside for extra scrutiny.

Over the course of more than an hour, and despite federal Judge Ketanji Brown Jackson’s increasingly apparent frustration with the shifting legal positions of the IRS, the DoJ lawyer said two things that should make everyone who is following the IRS scandals raise their eyebrows right through their hairlines.

IF the IRS were an individual, they would be presumed innocent.

Might I suggest that because they are instead an agency, they are entitled to no such presumption.

Instead, the IRS insistence they are accountable to no one should be grounds for disbanding this arm of the IRS.

No individuals from this arm shall be allowed future Federal Employment.

Any office subsequently chartered for this area of determination, regarding tax exempt status shall have open, transparent, and OBJECTIVE pass/fail criteria.
Said agency shall NOT be an arm of the IRS.

Of course, this is the test case for about 1,000 Tea Party cases. The DOJ has decided not to prosecute anyone in the IRS concerning these obvious violations. Now the Federal Courts are the only recourse. Let’s hope that our courts don’t become facilitators of the Obama organized crime machine.

Y’all need to prepare yourselves for this going very badly. Nothing is going to go against the IRS in this court. The fix is in. Kitanji ain’t going to go against a brother. Forget it. The judge is black as coal. Obastard has been pushing her along for some time now.

This, boys and girls, is an obastard tactic. Act outraged, investigate, stall, sweep it under the rug when the next crisis comes along. When asked about progress say you can’t discuss an ongoing investigation or court case.

This government is rogue and can’t be stopped legally.

I don’t support any type of income tax, even a flat tax, because it would leave the IRS and most of their hundreds of thousands of arcane rules in place.

Despite that track record, in court on Friday, the IRS offered to waive this statutory requirement – if only Z STREET would abandon its effort to find out what the IRS’s policy about such applications has actually been. How nice. Except Z STREET did not bring this lawsuit as a way to find out if its application for tax exempt status was accepted or denied.

Z STREET's doing this action on principle... something the IRS doesn't seem to understand. They're doing it for all groups - past and present - that could be stripped of their constitutional rights based on IRS whim...

The IRS is doing the equivalent of saying, "OK, we robbed you, now here's your money back. No reason to call the cops..."
