On Tuesday, a unanimous three-judge panel of the US Court of Appeals for the District of Columbia ruled that Americans born in Jerusalem cannot put Israel as place of birth on their birth certificates. Judge Karen Henderson wrote that the president exclusively holds the power to determine whether to recognize a foreign sovereign, and that the president had not recognized Israeli sovereignty over Jerusalem. Congress passed a law in 2002 dictating that Americans living in Jerusalem could label their childrens birthplace Israel, but the State Department has refused to enforce that law for over a decade.
Over 50,000 Americans have been born in Jerusalem.
The Obama administration has consistently refused to recognize Jerusalem as Israeli territory, let alone as the capital of Israel. The Democratic National Convention platform controversially removed language regarding Israeli sovereignty over Jerusalem

Shamefully, no U.S. administration has recognized Jerusalem as Israel's capitol. That was a decision made by Truman, and followed by Eisenhower, Kennedy, Johnson, Nixon, Ford, Carter, Reagan, Bush I, Clinton, Bush II and Obama. That is why the U.S. Embassy is, and always has been, in Tel Aviv.

Worse of all, Obama is violating a 2002 law passed by Congress which states that Americans born in Jerusalem could list Israel as their place of birth.
His lawbreaking is in plain slight and nothing is being done and the courts are complicit.
This should be no surprise coming from a man who has successfully obfuscated his own birth place.

This was initially an oil decision. Since, it has been for political correctness. But, as the world becomes educated that the religion of peace isn’t the pendulum will swing the other way. The finality will be when the US is oil independent. Then, Jerusalem will be Israel’s capital and our embassy will be there.
And we have elections for what reason?
And yet one cliche that I see periodically on this board is, "elections have consequences."

The Bush administration said that recognition is a presidential matter, and congress has no authority to intervene. The judge who wrote it is a Bush appointee. I think this is more a division of powers dispute than an anti-Israel dispute.
Although there’s not much doubt where Obama stands on Israel.
They DO allow passports to say “Jerusalem” as the place of birth, so at least nobody is forced to say that they were born in Palestine.

The Constitution gives the President the sole power to “receive Ambassadors” (Art. II, section 3), which has always been understood to mean that the President is the only one who gets to decide what foreign countries we give diplomatic recognition to. Since 1948, it has been the unbroken policy of every U.S. Administration to recognize Israel, but not to recognize Israel’s (or anyone else’s) claim to Jerusalem. So Both the Bush and Obama Administrations have refused to follow this law.
Ostensibly, the original reason was that the United Nations Resolution in 1947 that called for the partition of British Palestine into a Jewish and an Arab state called for Jerusalem (and Bethlehem) to be an "international" area, owned by no country and administered by the U.N. Neither Israel (which seized West Jerusalem in the 1948 war, and the rest of it in 1967), nor Jordan (which seized East Jerusalem and Bethlehem in 1948 and lost both of them in 1967), ever accepted this condition, but President Truman used it as a basis to decline to accept Israeli sovereignty over Jerusalem, and no President has ever changed that policy.
Congress and only congress can make law concerning citizenship.
