Gun Bill in Missouri Would Test Limits in Nullifying U.S. Law

Unless a handful of wavering Democrats change their minds, the Republican-controlled Missouri legislature is expected to enact a statute next month nullifying all federal gun laws in the state and making it a crime for federal agents to enforce them here. A Missourian arrested under federal firearm statutes would even be able to sue the arresting officer.

The law amounts to the most far-reaching states’ rights endeavor in the country, the far edge of a growing movement known as “nullification” in which a state defies federal power.

The Missouri Republican Party thinks linking guns to nullification works well, said Matt Wills, the party’s director of communications, thanks in part to the push by President Obama for tougher gun laws. “It’s probably one of the best states’ rights issues that the country’s got going right now,” he said.

The measure, which would seem certain to face a court challenge, was vetoed last month by Gov. Jay Nixon, a Democrat. But when the legislature gathers again on Sept. 11, it will seek to override his veto. Nearly every Republican and a dozen Democrats appear likely to vote for the override.

Richard G. Callahan, the United States attorney for the Eastern District of Missouri, is concerned. He cited a recent joint operation of federal, state and local law enforcement officials that led to 159 arrests and the seizing of 267 weapons, and noted that the measure “would have outlawed such operations, and would have made criminals out of the law enforcement officers.”

Historically used by civil rights opponents, nullification has bloomed in recent years around a host of other issues, broadly including medical marijuana by liberals and the new health care law by conservatives.

The 9th Circuit Ct just nullified Montana’s Firearm Freedom laws. It would be good to have this tested in another jurisdiction.

I am praying for this Bill to pass because it will effectively put an end to the New World Order plan. There is no way a New World Order could happen when the people are armed and ready to fight against federalism.

Anyone who thinks this NWO is a bunch of crap needs to look at the history of it and who supports it.

What it boils down to is whether MO will dig in it’s heels in other ways.

Will they allow their jails to be used to house Federal detainees?

Will they withhold tax funds?

Any federal agent arrested or sued would remove the case to federal court (28 U.S.C. 1442), which would immediately dismiss it.

New law effective today in Missouri:
Concealed carry permits had been approved by local sheriff, but had to be taken to drivers license bureau for carding. License bureau was scanning docs and sending to feds until discovered. Now local sheriff issues cards.

That implies that you HAVE to have a federal officer to make a criminal weapons arrest?

A really stupid argument to make.....

If the Feds want to make an arrest they should send one man who goes to the sheriff who then makes the arrest. We could cut some serious budgets right there.

It was the armed provincial militias, along with Libyan army deserters, who overthrew the dictator Kaddhafi and his elite guard and southern mercenaries. Thousands of Tripoli elitists were shot or hanged. That freaked out the NWO. The Libyan incident, IMO, is why we’re seeing a big push for gun control. The elitists are scared.

I’m a single woman in a rural county in Missouri living on a piece of property in the middle of nowhere, so owning firearms are not an option for me. They are a very real necessity for both self defense and for controlling the critter population. I’m the last person in the world to argue for Obama-type restrictions but even I can see that this bill as written is unconstitutional.

Charge them with Treason from the MO Constitution — and, if they're found guilty, kill and bury them the same day.
When the FedGov says you can't do that — tell them reverse our judgment and bring them back from the dead.
i.e. If the punishment is permanent, there's no undoing it.

There won't be a conviction because there won't be a trial. Once the charge is filed, the case is transferred to federal court, which will dismiss the charge as unconstitutional.
