Three Men ‘Illegally’ Arrested for Openly Carrying ‘Black Powder’ Pistols in Texas –

Three people were reportedly arrested on Friday for openly carrying Civil War-era pistols during a pro-gun protest outside the Texas Capitol. Gun rights activists tell TheBlaze the arrests were unlawful as it is legal in Texas to openly carry a pre-1899 antique firearm.

Terry Louis Holcomb, 44, identified as a Huntsville-area pastor, and Scott Douglas Smith, 50, a military veteran from San Antonio, and Gary Hayes, a quadriplegic, were reportedly arrested by state troopers in Austin and charged with disorderly conduct, which is defined, by law, as an action with a firearm “calculated to alarm.”

I think they have already won this in the court of public opinion. That picture speaks very loudly.

Nothing like arresting a disabled veteran for a civil rights protest.

The “disorderly conduct” charge is a loophole anti-gun advocates are pushing. Apparently they’re taking the meaning of “alarm” as liberally as possible so if you so much as see a gun on a person you can call the cops and say it disturbs you and demand they be arrested.

Texans should call their legislators and demand it be amended so these morons can stop tying up the courts on stupid arrests.

America has become a nation with such a maze of laws that the average person breaks 3.5 laws per day without even knowing.

Of course it is also becoming a big brother / police state, simply with a benevolent but still autocratic system that has suspended basic constitutional tenets for various ends that all seem to justify the means.

L.E. and intel in America has become para-military, they are above the law, enjoy special protections and using the veil of secrecy actions that are blatantly unconstitutional are implemented.

This is no longer the home of the “free and the brave.” It's just another luke warn and stagnant social democracy as in most of Europe.

Anyone remember when Kevin Ballew was shot 43 years ago in Washington DC?

Police raided his house for some reason. He jumped out of bed, grabbed a black powder pistol and was shot down.

Police claimed he shot at them but his pistol had only one shot fired and it was found 90 degrees away in the wall and one foot above the floor showing he was shot before he fired a shot while falling.

They tried to claim his house was raided because he had a sawed off shotgun. No sawed off shotgun was found. I don’t believe he was found guilty of anything.
