WASHINGTON Minnesota Rep. Michele Bachmann says House conservatives are preparing to sue President Barack Obama for executive overreach in response to his threats of unilateral action on a host of issues.
Hes the president of the United States hes not a king, the Republican lawmaker told reporters after Obamas State of the Union address. He may think hes a king, he may declare himself king, but thats not what he is under our Constitution.
Bachmann said an effort is underway in Congress to take back their authority under the Constitution as the House of Representatives. She said the plan is to introduce legislation allowing lawmakers to hire an attorney, so we can force the president to act under the Constitution.
Well sue the president of the United States and force him to no longer act unilaterally, she said.
In his address at the Capitol Tuesday night, Obama said he plans to take unilateral action on the minimum wage for federal workers. He suggested he might go solo on guns, for example.

The house impeaches, and then it goes to the senate to CONVICT. If convicted, he then is removed from office.
In a short sort of way, the impeachment is the charges brought and if found valid, it then goes to the senate for the conviction and removal.
Funny thing he conviction in the senate. the senators HAVE to be there, Have to sit silent and listen to the charges..they are the jury, with the chief justice presiding.

But sovereign immunity does not cover writs of mandamus — indeed only officials of the executive can be served writs of mandamus.
Why not bring full and open charges, vote and then impeach him as the Constitution directs? Then argue charges and force him to testify on his own behalf at his Senate trial.
This is crazy. If you sue him it will take years, if ever, to get anywhere. His high crimes and misdemeanors are ongoing. This is tantamount to letting him get away with it.
He'll have you (and us) standing against the wall with a blindfold and firing squad before you ever make any progress stopping him.

Because it would never get out of committee. Also, it would fail immediately in the Senate. It is a battle to gain some public traction. And nothing says 'traction' better than a president lying under oath.

Just yesterday they went after Holder again. This entire nation was warned about Chicago politics and it’s thugs by a number of Freepers. Yet, we have this rotten SOB in the White House blowing 1.4 billion plus for travel,and running our nation into the ground. Valerie Jarett with Obama’s consent had Iranian foreign agents meet in OUR White House. That is TREASON. One such Iranian foreign agent is a so called reporter/contributor for Arianna.

What??? Congress can force him to act under Constitutional limits any time they like - by zeroing out funding for all of his rogue agencies. Not one penny for the EPA, the IRS, the TSA, the Departments of Education, Labor, and HHS, or any other entity that has consistently been misused by statists against the public interest. Congress can slam the entire rotten infrastructure to halt - permanently - any time they choose to find the balls to do so.
Talk of lawyers and suing is idiotic, and further proof that the GOP is on board with most of Obama's agenda - they just know they can't yet afford to be seen by conservative voters as supporting it.
