Name mix-up in sexual battery case sends wrong Clay County teen to jail for 35 days

Cody Williams was arrested in late August, charged with the sexual battery of someone younger than 12.

The 18-year-old Clay High School student spent 35 days in jail.

One problem: He was the wrong Cody Williams.

A lawsuit for defamation of character and illegal imprisonment for about #20 million ought to get their attention.

Charges filed by the incomparable Angela Corey, of Zimmerman trial fame.

I am unclear why the article doesn’t mention that the DA might have some responsibility to be sure they’re charging the right person.

I was also rather appalled to find out that it was 35 days before the (wrongly) accused was given any details of the charges against him.

Luckily my last name is so unusual this would be very nearly statistically impossible to happen to me.

............my god!.........I think if I was putting a 17 year old kid in jail for over a month I would follow the BASIC established policies/protocols for being damn sure I was locking up the right kid!

I have been in jail a couple times for a couple days each time in my life and it is not something I would want a 17 year old kid to have to endure for 35 days!............in ERROR!

Another frightening fact is that Corey’s office charged him as an adult with child rape with no physical evidence at all. Obviously any comparison of DNA evidence would have cleared him, which means the entire case was based on one person’s claims. What protocols are in place to guard against false allegations, which are known to happen regularly? Or dies Corey just take everything at face-value and not ask questions like that?

Formal counseling for most officers, 10 day unpaid suspension and a transfer from investigations to patrol for another?
How is that proper punishment for screwing up this badly?

Had a case a little like this in high school. One of my friends parents got called to come to the school because he had been caught with drugs on campus. They get there and the cops harangue them for an hour before they let them see their kid. Only it turns out it was not their son. The school had two David Clarks and the wrong ones parents got called. David never new anything was wrong until he got home that night.

Hate to say it, but basically the police are immune from lawsuit unless it can be proven they acted with malice.

Ditto for a prosecutor.

They are even immune from civil suit if they lie on the witness stand under oath.

You may thank SCOTUS for that.
