Judge Rules 13-Year-Old Can Abort Her 30-Week-Old Unborn Baby (UK)

A judge in England this week ruled that a pregnant 13-year-old girl can have an abortion, even though she is 30-weeks along.

Justice Mostyn ruled she was capable of making decision after the girl, known only as “A” in court documents, said she was not ready to have a baby. She was 21 weeks pregnant when the case went before the High Court in mid-March, making it so her unborn child is roughly 30-weeks-old now.

teengirl2The teenager, who lives with her parents, only realized she was pregnant when her grandmother spotted her growing bump and took her for medical tests, the London Daily Mail newspaper reported.

The abortion comes as, in the United States, a new report from the Guttmacher Institute finds teenage abortion rates are down to their lowest levels since 1988, a drop of 66 percent from that peak.

The schoolgirl – who can be identified only as ‘A’ – is believed to have thought she had been gaining a little weight for other reasons.

A scan at a local hospital confirmed she was pregnant but the devastated girl said she was not ready to start a family at such a young age and wanted to have a termination.

The girl was 21 weeks pregnant when the case went before the High Court as an emergency hearing in mid-March.

The local authority, which is in the North of England, was forced to seek a declaration that the child had the capacity to make the abortion decision herself.

This was required to ensure that doctors and hospital trusts could not be sued if they carried out the medical procedure.

If the girl was not capable of fully understanding the situation, the local authority would be allowed to terminate the pregnancy if doctors believed it was in her best interests.

He said this was the case even if it might lead her to take steps ‘wholly contrary to her best interests’.

He said girl A was interviewed by a consultant psychiatrist who concluded very clearly that she had ‘a very clear understanding of her position and of the options that were available to her.

‘Those options namely continuance of the pregnancy, or its termination, were discussed.’

Mr Justice Mostyn said the law allowed a child aged under 16 to be given contraception if they had ‘sufficient understanding and intelligence’

The psychiatrist said that although A was ‘softly spoken’ she was able to explain to him that her wish was to terminate the pregnancy as ‘she felt that she could not cope with its continuance and it would stress her to a considerable degree.’

Geez, my kid was born early at 29 weeks, and is doing great, that is truly terrible.

She felt she was ready for sex, though, and that comes with consequences. If you're old enough to have sex, you are old enough to take responsibility for your actions!

Getting the baby out alive or dead isn’t going to be easy for a 13 y.o.

If she NEEDS to have the baby out, a 30 premature baby. has something like a 98% chance of survival. It’s obscene to order its death.

Oh, are they forgetting something? Uhmm. Like how ( when, where and by whom) did the girl ‘get fertilized’ in the first place? The girl who was complimented for ‘being quite aware of her situation’, OK, so has she had Sex Education in school yet?
Does she know she can always say no?

Guess adoption wasn’t pushed as an alternative...she has carried the baby this long, why not allow adoption. I can’t even imagine the pain this baby is going to go through when they do the abortion.

Is she ready to live with the fact that she will have had a viable human child-her own child-ripped apart inside her body when she could just induce labor early and let the poor child live? A parent I know once said that teenagers are “brain dead” until they're about 20. This one certainly lacks an understanding of basic facts of life.

This is completely ridiculous. Adoption, not abortion, is the best for ALL concerned. She's already carried the kid for 30 weeks, fer godsake.

Easy for the males to say!

A friend’s wife tried to explain the child birthing experience to me as the following: “Just take your upper lip and stretch it over your head.”

Since then, I have been somewhat unwilling to tell a female what to do regarding child bearing.

A 30 week old child is viable virtually always.

That’s the threshold for lung capability without having to be intubated with artificial surfactant.

What this stinking “judge” just ordered is a murder.

The child could be delivered by C section, brought to term in a NICU - as you know - and be adopted by some people who aren’t murderers.

May they all roast in Hell if they do this.

I'm disgusted that the judge wants to kill the baby. I am almost as disgusted that it took nine weeks for the judge to reach that decision - thoughtful is nice but some decisions should be quick, particularly if they are already made. I am also quite disgusted that no one in the UK is asking who got this little girl pregnant and how to protect her from him in the future. All in all, this is not a high point for UK parenting, courts, or medicine.

I believe that there are many reports of women stating that passing a kidney stone was worse than giving birth. If that is the case, then men are on par with women's physical, painful experiences.

IMHO.
