When Andy and Katie Johnson built a pond on their property in 2011 to provide water for their cattle, they never dreamed it would result in threats of $75,000 a day in fines from the Environmental Protection Agency.
The Johnsons believed they had done everything necessary to get permission for the pond, where the tiny Six Mile Creek runs through their property south of Fort Bridger, Wyo. The Wyoming State Engineer's Office provided the permit and even stated in an April 4, 2013 letter to the Johnsons: "All of the legal requirements of the State Engineer's Office, that were your responsibility, have been satisfied for the Johnson Stock Reservoir."
The EPA saw it differently -- and sent the Johnsons a Jan. 30 notice informing them they had violated the Clean Water Act, which could carry thousands of dollars in fines.
"I believe that the EPA does need to regulate industry and the bigger projects," Andy Johnson conceded, "but my little pristine stock pond, I believe, is a waste of our taxpayer money for them to come after me. It's a waste of my time, it's a waste of my money and we're going to fight it."
In their notice, the EPA cited the couple for "the discharge of pollutants (i.e., dredged or fill material) into the waters of the United States," for building a dam and for not getting a permit from the Army Corps of Engineers.

The Johnsons and their attorney say Six Mile Creek has long been diverted about 300 yards below their property into a man-made canal used for irrigation.
"There is no connection to the river," Andy Johnson maintains.
They live 100 miles from the Green River.
Ha...hope they have mineral rights....
The Green River formation weighs in at 3 TRILLION Barrels of oil.
They might like to invite an oil company to drill...sounds like they have plenty of water from their lake for the FRACKING.
They have no idea either, they sit around and probably figure out ways to screw the population over anyway with things they have no clue about...

If brown trout can live in that pond, they’re not polluting anything. How it could possibly be affecting any navigable waterway, I have no idea.

FNC showed an interview with him and his wife Monday. He said that bald eagles came to the pond, it had brown trout, and the camera showed other birds. He said the EPA was referring to a river about 100 miles away that they claimed he was ‘messing up’ (my words). ...The pond looked great.

It's easier to do than that. Just cut the electrical power. Most cities would be chaotic death traps in a matter of days.
Anyone with half a brain would know that a properly constructed pond, with the right vegetation acts like a giant water filter. It would appear to me that they are actually helping to improve the water quality on that stream. If anything, the govt should be giving tax breaks to people that do this.

Its the Clean Water Act from 1972.
You can't say exactly when construction began but somebody tipped off the Corp of Engineers, who actually issues the permit, and they call the man in early Sept 2012 to tell him he needs a permit and ask him to submit his plans. He didn't submit so the Corp goes out and inspects the jobsite then write him a letter in Oct 2012 telling him again but again he doesn't submit.
The Corp turns it over to EPA for enforcement in Feb 2013 but he never responds EPA either so in Jan 2014 EPA writes him the threatening letter.
