Man angry after police break into and damage his truck over dubious marijuana suspicion

Matthew Heller was returning to his truck after having attended a Juicy J concert in Ybor City, Florida last February when he noticed something was wrong. As Mr. Heller told WFLA News Channel 8, “I come outside, jump in the truck, and the whole thing’s been torn apart inside, wires had been yanked out, the paneling had some scratches on it…” One might think that maybe it was a burglar who had been inside his truck, but nope. It was the police, and Mr. Heller knows that because they left a note saying exactly what they did.

You know why they chose HIS (nice) truck? Because they WANTED it.

Because of civil forfeiture —if they found dope, they could seize the vehicle.

I think the only way this stuff is going to stop is when the victims take the cases to trial, and the juries give awards that literally bankrupt municipalities (not this case, per se, but the shootings, home invasions and other violations of constitutional rights that destroy lives). There is no punitive effect on the police when all that happens is the residents foot the bill for their wrongdoing through increased property taxes or insurance costs incurred to settle lawsuits out of court.

We did not find anything illegal, and we apologize for destroying your vehicle. Please come down to the station to pick up your check, so that you can buy a new vehicle. Again, we acted stupidly and we apologize. In addition, the town will pay for a rental vehicle, and the gas that you use until you are able to buy a new vehicle. Also, if you missed work or your wife divorced you over this, we will fully compensate you.
We promise that we will not play the Gestapo again, and that we will respect your rights and those of other citizens in the future. We, like you, do not want this country to become a police state.

I remember a case not too long ago where they reviewed a drug dog’s record. Turns out the dog was wrong as much as he was right. Basically a coin flip, but still probable cause in the eyes of the law.
