It’s not true they can’t determine his intent without talking to him. The Manual for Courts Martial says that circumstantial evidence can be used to determine intent to desert. Such things as prior to departure taking care of possessions or finances are among those actions listed that can be used to determine intent.

Every one of his team members say he deserted. They reveal in this article that the Army report acknowledged that he probably deserted.
The easy way out for the administration on this is to find a commander who will recommend some level of non-judicial punishment and a lesser discharge.
Should be a court martial and imprisonment, but that’ll make the Obama look ignorant publically. If Obama can say Bergdahl did face consequences and have those be very limited, then he gets to save a good bit of face.
Nothing they do can make up for the stupidity of trading 5 top generals for one deserter PFC.

I would not be surprised if the Obama regime transfered Bergdahl to The Old Guard.

Should this occur, the persons who exacted the “barracks justice” upon Bowe Bergdahl would themselves be subject to some pretty severe penalties.
Give the guy a discharge, and remove him from what is certain to be a very hostile workplace environment. There are any number of highly sympathetic venues where he never again has to fear retribution.
And yeah, it is a springboard to an elective office in a “safe” district.
It’s all about mentality. If a guy deserted because of supposed fear under fire. I would keep him out of combat action. There’s no knowing if he really has developed somehow better brass this time around.
Funny how the “manual” is not utilized in a civilian court (legal process)...
I say put him back on the front line...

I’m betting they assign him to a Personnel Control Facility. It’s not a jail. It’s more of a temporary holding facility.
