To quote Denzel Washington from the movie Training Day: “This is chess, it ain’t checkers!”

Since she heads some sort of state-wide, super-duper position to supervise political corruption in the whole state of Texas I think Perry has every right to apply pressure in a variety of ways to get Rosemary “Straight-Vodka” Lehmberg to step down from office.

Otherwise, who is going to make that request of her and apply convincing pressure - you or me, who are nobody’s?

I just watched Perry’s 6 min. statement on youtube and have to say he was not as polished as I expected. In this particular case I hope and expect he will come out on top, but for 2016 the GOP must field a 100% reliable communicator. The transition to the border issue at the end didn’t work for me.

First of all, this isn’t a movie so whatever was quoted in one doesn’t really have any bearing on the reality of the thing.

Second of all what you think has no bearing on the law here.
She’s an elected official who answers to Travis County and it’s voters. Not the governors office.

Third of all. I stated I expect the Travis County voters will bounce her when she’s up for re-election.

The voters of the county could recall her. Perry didn’t have that authority.

Whether or not she’s a drunk has nothing to do with the coercion question. If Perry had the power to fire her, he would have just fired her. He didn’t and so he used coercion instead.

This article states that Mr.Reed is trying to invoke a rarely used procedure for removing an elected official via lawsuit.

Maybe Perry should have joined forces with Mr. Reed as that’s a legal remedy. Coercion isn’t. Even more so when Perry was under investigation by an office she heads up.

I personally think Governor Rick stepped in it.

No. I have a habit of defending the rule of law.
The fact that somebody I don’t like broke the law doesn’t entitle me to break as well on the argument that they did it first.
Lack of accountability is one of the largest problems in our society.
I’m for that regardless of what “Team” they play for.
I think the DA should have resigned. She wasn’t legally required to and she didn’t.
I think Perry overstepped the limits of his authority. If it turns out he broke the law, he should be held accountable.

2) A copy of the two provisions which Perry is charged:

§ 36.03. COERCION OF PUBLIC SERVANT OR VOTER.

(a) A person commits an offense if by means of coercion he:

(1) influences or attempts to influence a public servant in a specific exercise of his official power or a specific performance of his official duty or influences or attempts to influence a public servant to violate the public servant’s known legal duty; or.

(2) influences or attempts to influence a voter not to vote or to vote in a particular manner.

(b) An offense under this section is a Class A misdemeanor unless the coercion is a threat to commit a felony, in which event it is a felony of the third degree.
(c) It is an exception to the application of Subsection (a)

(1) of this section that the person who influences or attempts to influence the public servant is a member of the governing body of a governmental entity, and that the action that influences or attempts to influence the public servant is an official action taken by the member of the governing body. For the purposes of this subsection, the term “official action” includes deliberations by the governing body of a governmental entity.

§ 39.02. ABUSE OF OFFICIAL CAPACITY.

(a) A public servant commits an offense if, with intent to obtain a benefit or with intent to harm or defraud another, he intentionally or knowingly:

(1) violates a law relating to the public servant’s office or employment; or.

(2) misuses government property, services, personnel, or any other thing of value belonging to the government that has come into the public servant’s custody or possession by virtue of the public servant’s office or employment.

(b) An offense under Subsection (a)(1) is a Class A misdemeanor.

(c) An offense under Subsection (a)(2) is:

(1) a Class C misdemeanor if the value of the use of the thing misused is less than $20;.

(2) a Class B misdemeanor if the value of the use of the thing misused is $20 or more but less than $500 ;.

(3) a Class A misdemeanor if the value of the use of the thing misused is $500 or more but less than $1,500;.

(4) a state jail felony if the value of the use of the thing misused is $1,500 or more but less than $20,000;.

(5) a felony of the third degree if the value of the use of the thing misused is $20,000 or more but less than $100,000;.

(6) a felony of the second degree if the value of the use of the thing misused is $100,000 or more but less than $200,000; or.

(7) a felony of the first degree if the value of the use of the thing misused is $200,000 or more.

(d) A discount or award given for travel, such as frequent flyer miles, rental car or hotel discounts, or food coupons, are not things of value belonging to the government for purposes of this section due to the administrative difficulty and cost involved in recapturing the discount or award for a governmental entity.

Wow. I hadn’t thought of that, but I think you’re absolutely right. In past elections (waaay past) this geographical difference was considered by the parties (i.e. Goldwater - Arizona/Miller - Northeast; JFK - Mass./LBJ - Texas). Romney’s little “me-too” guy from another liberal state gave him no outreach at all. He was supposed to be so smart? Maybe not politically, except for destroying his opposition in the party and burning bridges that could have helped him win.

No, I didn’t like him much, but I knew the difference between him and what we got - that’s why I said I would have voted for a shetland pony to get Zero out - anyone, anything. And we who said so were right.

It’s a badge of honor. Perry needs to shout this from the rooftops. His pressman needs to pull every political indictment by Dems for the last fifty years and how much worse it has gotten. Show just how they’ve corrupted the system over time.

I thought enough of this post to copy it here for perhaps more wider distribution ... one man’s recommendation on how to proceed:

Ernest Peluso

Demand an immediate trial and simultaneously move to dismiss the corrupt and politically motivated Indictment.

Force the trial court to address this issue immediately after arraignment.

Insist that the extraordinary nature of the charge, coupled with its frivolous and mean spirited nature, justify an interlocutory appeal to the Texas Court of Criminal Appeals.

Invoke Constitutional and Texas State Speedy Trial provisions. Waive nothing. Make the prosecutor meet his burdens this fall, not two years from now.

At the same time, file a suit against these folks in US District Court under 42 USC 1983.

It’s true that prosecutors enjoy the broadest immunity from liability in our justice system, but this is a violation that is so breathtaking in its naked lawlessness that the federal courts up through the 5th Circuit could entertain it.

Demand millions in damages.

If the suit succeeds, the people who executed this farce could be personally liable. Seize the initiative. Don’t cede anything to these villains.
