Vanity: Constitutional Amendment Booklet

So, I've been working on a little booklet to present/illustrate the reasons why the amendments are needed in addition to the amendment-text itself — I'm not entirely pleased with the justifications I've written up, and I'm not sure that these are enough for presenting to an Article V Amendment-convention, but nonetheless here they are.

I respectfully disagree that there is a problem with the emergency increase measure. This measure requires the federal government to get the permission of the states to raise the tax rate to address national emergencies. Therefore the federal cannot fabricate a national emergency simply to raise taxes. There is no opt out and no greater ability for the federal government to extort a state than currently exists. If the federal government wants more money, absent a national emergency, they will have to encourage business activity. And there is no other form of taxation just the sales tax at the state and federal level. If localities want money they can impose a sales tax at the local level. Certainly there are issues to work out in this approach, but as you say this approach eliminates the opportunities for mischief.

I think the elimination of judicial review is vital. We essentially have two methods to remove judicial tyrants from the bench, impeachment and elimination of their seat or bench. Congress has the power to do both but the democrat party protects the lawless judges that dictate their will upon us. Our founders never envisioned a political party in congress protecting lawless judges from removal. Yet that is what we have. Thus, the removal of judicial review is the lesser of the evils. Much of the "constitutional issues" we have will probably dry up and blow away when the left cannot impose their will upon us using the courts. Yet you raise a vital point. Surely there will arise constitutional issues that require resolution and thus some type of body to address these issues is needed. The federal courts have failed as that body exposing a fundamental weakness in our constitution. I suggest a super-majority of both houses of congress resolve these issues. I don't think their schedule will be a problem once we remove the congressional ability to buy votes using the treasury and penalize their enemies using the tax code. Even this approach needs a control so I would provide the states an ability to over rule the decisions with a super majority of some kind.

My post is addressed at only a small portion of your suggestions. While I believe we need expert opinion to craft new proposed amendments, we also need laymen heavily involved. Would have got back to you sooner but I lost two well crafted responses on my I Pad. My I pad locks up so often using OS 8.0 and now OS 8.1 that you would think it is an old Microsoft unit. Indeed I am typing this on my Windows gamer because it is far more stable than my apple device. There is irony here. Roll on FReeper! Apple lovers flame away! IOS 8.0 and 8.1 S@CK!

True, but one reason that it's so freely ignored is that there's no teeth in violating it — some of these mandate high prices for doing that.

The problem with treason is that it is very hard to prove, and that is by design:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.
You see, without this strong definition we'd have Treason charges thrown about haphazardly, like they like to do on TV.

Now, this doesn't mean that I think they are free of Treason, far from it, I am convinced they intend to enact it with their amnesty to the invaders. — I also think that we could trap them, but doing that [IME] requires us to have governors willing to make the first move

18 U.S. Code § 2381 - Treason
Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.
There's the punishment that Congress has declared…

FIRST, Throw every "ESTABLISHMENT REPUBLICAN" OUT, even if you have to vote for a 'RAT.
SECOND, Replace every elected official with a hard charging conservative (read TEA Party).
