President Obama’s new Harvard Law Review article
The Washington Post ^ | January 5, 2017 | Will Baude

The Harvard Law Review generally comes out on the first Thursday of the month, and this month’s has an interesting lead article: “The President’s Role in Advancing Criminal Justice Reform,” by Barack Obama. There’s a lot in the article, which is 56 pages with 317 footnotes, and of course I agree with a lot of it. But for now I have three questions — one substantive and two procedural.

1: Could we hear more about the limits of the president’s role? The article makes occasional references to “important structural and prudential constraints on how the President can directly influence criminal enforcement,” but most of the article is about things the president has done or would like to see done. At the same time, some of us have wondered why President Obama — who was not always shy about unilateral executive action — did not do even more. The author of this piece probably has unique insights into that question, which it would be great to get candid scholarly analysis of.

2: Did he write it, and should we care? Unlike with his recent JAMA article, I did not see a note about “Additional Contributions” of research assistance or other outside feedback, but I do not know whether the president had time to type up the whole thing himself.

. . .

3: Why is the president of the United States publishing in a law review? I am a defender of law reviews against their many detractors, but who is the target audience for this article and what is the point of writing it? . . .

There are links in the article, including a link to President Obama's law review article. Here's a snippet of his writings:

"Criminal justice reform has been a focus of my entire career — even since before my time at the Harvard Law Review. As a community organizer, I saw firsthand how our criminal justice system exacerbates inequality. It takes young people who made mistakes no worse than my own and traps them in an endless cycle of marginalization and punishment."

I don't think he wrote it. Do you?

If I am correct he never wrote an article for the Harvard Law Review when he was in its editor.

I wonder if this article is a response to others’ comments that as a past President of the Harvard Law Review he’d never published.

It also makes me think he’s going to go back to community organizing once he’s out of power. Just great.

He wrote 56 pages and 300+ footnotes? I say no way did he produce more than 5% of it, if that. He seems way too lazy, and the parties and golf courses are calling.
But does this mean he wants a high-powered law job as a rainmaker? Does he even have a license? Probably more that he wants revolution to trash the justice system because it’s “raciss”.

“Did he write it?”

Did Obummer sit for the LSAT exam or have someone take it for him? What was his score on the LSAT and how does it compare with the rest of his class? How did more qualified applicants feel about Obummer becoming president of the Law Review?

Inquiring minds want to know.

“Who” wrote it for him? He sure didn’t have a hand in it.

He didn’t write that! His name is on it. But it was written by committee.

He contributed. He does not have the intellectual capacity to go on for 56 pages unless he’s repetitive. But then it would not pass muster in a review.

I have watched enough of Obama over the years to conclude that he just doesn’t have it upstairs to carry out a substantive analysis. One would not expect him to be as complete and penetrating as other legal scholars but he does not even come close.

I believe it is a fact that he never published for the Harvard Law Review while he was the editor there. That fact tells me he was an affirmative action plant because nothing else adds up.

His records are sealed and I can’t think of a cause for a court to unseal them. But if they were somehow unsealed, I think the damage to the democrat party would be enough to sink it which is saying a lot.

As it is the democrat party will stage a comeback after they’ve figured out how to counter President Trump on Twitter. And they will, unfortunately. They will keep trying until they find something that sticks. It won’t matter to them how much lying or cheating it took to get them to a point that they gain an edge or foothold. All that matters to them is winning.

Rumor has it that Bezos (Amazon) will have WAPO (he owns it) buy Twitter. Perhaps President Trump can help foster other social media forms that will counter the fight to control the social media space.

Really ready for this POS to just go away but if he has to stick around it will be enjoyable to watch him witness the unraveling of the ideas he supports.

The pendulum wings.

That's what is reported. Now, approximately 20 years later, here's his article.

The article discusses some reforms that are badly needed, it is inarguable. Some of the sentences handed down at the federal level are unconscionable and mandatory. In my own family a situation happened where a family member who had without question reformed many years previously, was imprisoned for three years for something she'd done over five years previously. She was turned in for her five-year-old prior bad act (which harmed no one, she mailed some drugs to another state) by someone recently arrested. Apparently the feds give lighter sentences if you snitch on others. Even if it was far in the past.

Did he write it?

Unlikely. Not only is he too lazy, but he would not have the skills or the time to do so. According to Ted Cruz, who was on the Harvard Law Review at the same time as Odumbo, Odumbo didn't produce anything while there. Also according to Cruz, Odumbo did not make the Law Review due to grades or a written submission as most people do, but was admitted due to his "special" status (see tagline). If his name is on the article, somebody else wrote it for him.

Harvard Law Review articles

In 1990, Obama beat out 18 other contenders to become the first black president of the Harvard Law Review, where he spent at least 50 hours a week editing submissions from judges, scholars and authors.

According to Politico, there were “eight dense volumes produced during his time in charge there – 2,083 pages in all.” No published writing from obama?

According to Politico, Obama’s name does not appear on any legal scholarships during his time at Harvard.

Why Didn’t Obama Publish anything in the law journal he edited?

Change in Selection System of The Harvard Law Review in the 1980’s.

Mr. Obama was elected after a meeting of the review’s 80 editors that convened Sunday and lasted until early this morning, a participant said.

Until the 1970’s the editors were picked on the basis of grades, and the president of the Law Review was the student with the highest academic rank. Among these were Elliot L. Richardson, the former Attorney General, and Irwin Griswold, a dean of the Harvard Law School and Solicitor General under Presidents Lyndon B. Johnson and Richard M. Nixon.

That system came under attack in the 1970’s and was replaced by a program in which about half the editors are chosen for their grades and the other half are chosen by fellow students after a special writing competition. The new system, disputed when it began, was meant to help insure that minority students became editors of The Law Review. ………………………………………………………………………………

Obama was a “minority student” He was chosen by fellow students through a “special writing competition”.

No “special writing competition” by the “minority student” obama has been published or released by Harvard that would explain or justify how obama was chosen by fellow students for his “writing skills”.

This is how obama was chosen to be the president and editor in chief of the Harvard law review. Though writing skills competition. Yet obama DID NOT PUBLISH ANYTHING OF HIS OWN!

Let me review. Obama has NO RECORD of ANY WRITING SKILLS or PUBLISHED ANY WORK of HIS OWN WHLE AT HARVARD!

OBAMA HAS PUBLISHED NOTHING AT HARVARD YET HE WAS THE PRESIDENT OF THE HARVARD LAW REVIEW AND WORKED AS AN “EDITOR IN CHIEF” 50 HOURS A WEEK?

Obama was chosen because of affirmative action and because he was a “minority student”. Obama was not chosen because of any published writing skill. No published work equals ZERO proof obama is a “skilled writer”. There is no EVIDENCE obama ever did ANYTHING to qualify for the position of president of the Harvard Law Review except though AFFIRMATIVE ACTION for his minority.

Obama seems to have had affirmative action help but there is NO evidence he EVER QUALIFIED for any help through his WRITING SKILLS! Obama ONLY qualifed because he was a MINORITY!

This is why there is no record of any published works from obama while he was the “president” of the Harvard law review.

AGAIN I HAVE PROVED OBAMA IS A TOTAL FRAUD AND IMPOSTER!

………………………………………………………………………………

I believe obama has used his”affirmative action plan” to move through the shadows of his hidden “education”. In other words I believe obama has used the system to ingratiate himself into the affirmative action system to promote himself. THIS IS WHY HE WILL NOT RELEASE ANY TRANSCRIPTS,THESIS STATEMENTS,OR RECORDS OF ANY KIND from the various schools he says he attended. I believe obama is a low grade empty suit. Obama has proven he is not a scholar by not publishing or releasing ANY records of his college education or any interview with the Harvard Law Record Newspaper. He has in effect revealed himself as an imposter.

Some of the comments at the WaPo are priceless:

DiverDan says: “I believe he wrote it himself. He dictated the whole article to his secretary. While reading from a teleprompter.”

Volucre says: “It’s a little bizarre that the President of the United States — whose job grants him the power to speak with more public authority and influence than arguably anyone else in the world — has chosen to expend much of his limited time expressing himself in a medium that will reach a tiny audience, who probably aren’t even that interested in his work’s intellectual content.

“It’s hard to imagine, say, George Washington or Abraham Lincoln casually taking enough time off from leading the country to write 56 pages with 300+ footnotes about legal issues he liked to muse about.”

hugh prestwood says: “ “I will say that we were very impressed by the level of engagement that the president gave our comments and our editing process in general”

“Frankly, I’m surprised a man of such towering intellect and Ivy League scholastic accomplishment needed any editing at all – much less it being done by law school students who had to “work through the night”. Of course, unless I missed it, up to now the mainstream media has had little or no interest in digging up anything he wrote while in law school. At least we get to read this “polished” piece. Maybe someone will leak the unedited version.

“As to the question — “why is the president of the United States publishing in a law review”, my guess is that having been affirmative-actioned from his college freshman year all the way through to the presidency, he longs to return to those halcyon days when he was surrounded solely by fellow ultra-left-leaning law students who could – and can — always be counted on to mistake charisma and rabid social-justice ideology for wisdom and depth.”

“...but who is the target audience for this article and what is the point of writing it?”

Academia and the Left is the target audience. This way he can put himself out there as a University president/chancellor (for an 8 figure salary, of course). The point of writing it is to show he still matters.

He never was “editor”...didn’t they change the title to accommodate him...President? The affirmative-action loser never wrote anything. Still hasn’t. Whoever this idiot is, he is the Manchurian candidate.
