40% of the federal bench are Obama stooges thanks to Reids packing of the courts. We should create a lower level of Federal court which would be stripped of it’s power to set precedent and whose outcome would be limited only to the defendants and that in turn limit to groups of 100 or less. Then move the stooges to those lower courts.

By granting Pardons to Homeland Security Agents that refuse to follow the Judge’s order, President Trump would not be breaking the law and could not be impeached.

This judge should be in page for interfering with the National Defense of the United States which is under the authority of the president of the United States and not the judicial branch

Judges have to be impeached if direct evidence of incompetence is not available, but they are guilty of improper rulings or acting under undue influence from some third party.

Otherwise the only option is to convince them to “resign”.

Just a guess...Trump will rush through his permanent extreme vetting process and put that in place very soon. Won’t wait 90 days to do so.

It all works.

The president can fire or suspend Homeland Security Agents that abide by the court order and he can Pardon Homeland Security Agents that refuse to follow the judge’s order.

He can also install Military Police to take the place of the dismissed Homeland Security Agents.

This is not the system our Founders designed. The Congress granted the president these powers nearly 70 years ago. It is an obscenity that a single low-level judge can stand in the way of that massive precedent.

The federal judge does NOT speak for the country as his restraining order countermands the Constitution! President Trump was entirely within his rights when he issued the EO. The days of bench legislation ARE OVER!

Over the last decade, the will of the people has manifested itself in winning statehouses, state legislatures, both houses of congress, and now the presidency.

And one judge thinks he can go against that?

Where in the constitution does it say that people who are not citizens and not physically in this country get some sort of right of entry?!!! He’s essentially legalized illegal immigration...dissolving the notion of a national boundary.

I think this judge said that application of the law is one thing, but a judge must take into consideration the effect a law has on society, and rule accordingly. In other words, this judge is fully on board with legislating from the bench if such actions advance social goals.

I found the judge's ruling. It doesn't even touch the merits of the case. The standing of the states is based upon some of the visa holders being enrolled in state universities. He agreed with their argument that irreparable harm would occur if the temporary restraining order wasn't issued.

The ruling doesn't touch the legal standing of the executive branch to enforce laws, or the legality of the specific law in question. My guess is that the Administration will have to prove irreparable harm and/or that the federal government's interests outweigh the states'. Interference in constitutional responsibilities will hopefully win this case for the federal government.
