Joe Biden tells Fox News he won't appear voluntarily as witness in impeachment trial

Former vice president and 2020 Democratic front-runner Joe Biden told Fox News' Peter Doocy Wednesday that if called by the Senate to testify in President Trump's impeachment trial, he would not voluntarily appear.

"The White House is now saying that if there is a Senate impeachment trial they might like to call you as a witness. Is that something where you would appear voluntarily?" Doocy asked Biden as he continued his "No Malarkey" campaign tour, making a stop in Iowa on the first day of the public House Judiciary Committee hearing back in Washington, D.C.

"No, I’m not going to let them take their eye off the ball," Biden said. "The president is the one who has committed impeachable crimes, and I’m not going to let him divert from that and I’m not going to let anyone divert from that."

If the Senate subpoenas him, the Trump DOJ would be happy to enforce it.

He will appear and he will testify or take the 5th.

Period.

I heard audio where he just said flat-out he wouldn’t testify.

I expect Lindsey Graham to back down.

I’ve noticed less and less talk of calling the Whistleblower, and every member of Congress that follows the Media rule of not mentioning the ID of the Whistleblower, they are siding with the Activist Whistleblower over the President of the United States.

That trend is very bad.

They conveniently left out that Biden told them they would not get $1 Billion dollars if they didn’t fire the Prosecutor Investigating Burisma!

Especially when the judge issuing the impeachment subpoenas at that time will sign his name, John Roberts at the bottom. BTW the dem’s forgot that the job of the presidents defense team will be to impeach the “witnesses” and “evidence” of the prostitution team provided by the house to try the case. Yes it’s actually the dem’s who will be on trial for 6-8 weeks.

That article is outrageous.

It doesn’t say that anyone is accusing Biden of wrongdoing. It doesn’t use the word “exchange,” as “in exchange for” but it does with Trump.

It only says Trump and some Republicans want Biden to be a witness. No suggestion of wrongdoing on the part of Biden.

I'm betting he won't. If the Senate subpoenas him the he will challenge it in court. The legal proceedings will last longer than the Senate trial will.

The courts have no role in adjudicating a Senate subpoena.

Unless the Senate grants it to them through default.

But the Executive can enforce it once issued.

Because the House has ceded their constitutional authority to the courts does not mean the Senate must.
