I agree with Turley that this was a horrible pardon/clemency by Trump, but DOJ is going after him just to poke Trump in the eye. It’s also a chance for the left to highlight Trump’s clemency to an undeserving scumbag. Garland might also go into Esformes path to clemency, donations, influence, etc. They are attacking Trump from as many directions as possible, and have unlimited resources.
Trump commuted the sentence of this guy, but there were other counts on which the jury deadlocked on which he was not convicted, and those can be retried. Because Trump only commuted the convictions, but didn't pardon the guy, it is perfectly legal to retry him on the counts for which Trump did not commute his sentence.

Unless the jury was deadlocked on "the 6 counts he wasn't convicted on," he can't be tried again for those counts. That would be double jeopardy.
The DoJ either has to have a mistrial on those 6 counts, or they need to find new counts to try. If he was found not guilty (not "not convicted"), then those charges have been disposed of forever.
And to think that Garland was almost a Supreme Court Justice?
