That act of weaponizing the DOJ was shocking in that it violated accepted norms the Constitution. …
Why soft-pedal? Why try to minimize the unconstitutional outrage that occurred?

Think, Merrick Garland was one micron away from a Supreme Court appointment........He’s just one vindictive little bitter bastard with an age 5o grind and a money laundering patronage network he has to protect like Al Capone, and he is piling up the damage like a Panzer Tank on I95. I agree with Turley that this was a horrible pardon/clemency by Trump, but DOJ is going after him just to poke Trump in the eye. It’s also a chance for the left to highlight Trump’s clemency to an undeserving scumbag. Garland might also go into Esformes path to clemency, donations, influence, etc. They are attacking Trump from as many directions as possible, and have unlimited resources.

Just to be clear, this is kind of slimy, but it isn't illegal, and they're not undoing Trump's action.

Trump commuted the sentence of this guy, but there were other counts on which the jury deadlocked on which he was not convicted, and those can be retried. Because Trump only commuted the convictions, but didn't pardon the guy, it is perfectly legal to retry him on the counts for which Trump did not commute his sentence.

Unsatisfied with Esformes serving “time served” and paying fines and forfeiting 38 million dollars, the DOJ plans to retry Esformes on the 6 counts he wasn’t convicted on.

Unless the jury was deadlocked on "the 6 counts he wasn't convicted on," he can't be tried again for those counts. That would be double jeopardy.

The DoJ either has to have a mistrial on those 6 counts, or they need to find new counts to try. If he was found not guilty (not "not convicted"), then those charges have been disposed of forever.

And to think that Garland was almost a Supreme Court Justice?
