Judge denies Jack Smith's deadline request, leaving classified document trial date in doubt

A federal judge in Florida denied a key deadline request on Thursday from special counsel Jack Smith in the case against Donald Trump, alleging the former president unlawfully retained classified documents.

United States District Judge Aileen Cannon's decision, in which she rejected Smith's request that Trump notify him by mid-December of any classified evidence he plans to use for his defense, is yet another indicator that she is likely to postpone the trial's start date.

The trial is currently set to begin on May 20, 2024, but Cannon said last week she would evaluate numerous outstanding deadlines at a scheduling conference on March 1, 2024.

The deadlines include requirements parties in the case need to meet under the Classified Information Procedures Act. Cannon's decision on Thursday, related to Section 5 of CIPA, confirmed that anything in the CIPA process beginning with Section 5 will not occur until after the scheduling conference, leaving what is expected to be months of back-and-forth filings that would run into the trial if the date of it remained intact.

CIPA is used in cases that involve classified material and governs how that material is managed in legal proceedings. Section 5 requires defendants to give notice to prosecutors about what classified material they plan to use during trial.

Prosecutors for Smith had asked Cannon to order Trump to notify them by Dec. 18 of which material he planned to disclose at trial from the 5,500 pages of classified discovery that prosecutors had provided to him.

"Providing such notice by a set, near-term date will facilitate the completion of CIPA litigation before the May 20, 2024 trial date," prosecutors argued.

Cannon said in her brief order Thursday that "CIPA Section 5 deadlines, and all other pre-trial deadlines not included in the first batch of pre-trial deadlines" will be addressed at the scheduling conference in March.

The decision is a blow to prosecutors, who have little recourse to fight Cannon's scheduling orders and who have aggressively attempted to keep the trial on track. The decision is, by contrast, a win for Trump, who is the leading 2024 Republican presidential contender and has repeatedly pushed for the trial to take place after the election.

Smith's office declined to comment.

Oh, no…I wonder if DuhSaintis has ever exchanged pleasantries with Smith the dragon slayer? The public would never know, since the Florida state legislature put the iron dome over Duh-Saintis coming and goings.

They’ll declare him a flight risk and make him wear an ankle monitor during the campaign. Can you imagine President Trump showing that off at his rallies? That would get him another 4% of the vote.

Or they’ll declare him such a high flight risk that they need to take the extraordinary step of “pre-trial detention,” i.e., lock him up.

If Biden somehow makes it all the way to a debate against Trump, Donald just has to repeatedly point out that Biden as a senator and then VP had zero legal reason to have so many classified documents unsecured for so long.

Even after the Democrats steal 2024, at some point we reach a tipping point of patience as the economy crumbles.

The moderators will never get to that topic, They will focus on the top 5 topics for Dems...climate, education, diversity, equity and inclusion.

So outside of DC, Chief Inquisitor Mad Jack has a tougher time then being in a place where the “judges” all understand that they are just employees and need to go along with their upper management’s demands.

Must be frustrating for a guy with a tight schedule.

Biden did not retain nor did he ever have “highest classification authority” (prior to being elected President), and there seems to be no legal justification for him having classified materials in his possession:

Biden’s FBI has been found to be weaponizing all 17 of the
US’ tax-supported intel agencies, and its resources, along w/ the Biden DOJ, DHS, etc.

Biden is allegedly monitoring and surveiling American voters.....supporters

I was living here in FLorida long before DESanctimonious. Everything is up 50% under DESanctimonious. Insurance, utilities, taxes. While DESanctimonious is busy running for president, and his focus is on Disney, and other social issues which do not affect me one iota. What affects my everyday living is money taken out of my pocket for insurance, utilities and local taxes.

The entire strategy of tying Trump up in litigation has completely backfired. The expectation clearly was they’d get a conviction on something and then the states or the RNC would declare him ineligible to run (that pesky Constitution would not allow the Feds to do so). The overwhelming majority of Republicans and at least half the independents see the prosecutions as political persecution and are greatly opposed to the country becoming a banana republic. As a result with every indignity Trump’s popularity grows.

The dramatic increases in his support from the black community must be particularly galling for the Dem strategists who have no clue about what anyone outside the elite circles in DC, Manhattan, Chicago, San Francisco, and LA think. As you suggested, put an ankle bracelet on Trump or put him in a jail cell and his popularity will only increase. At this point the majority of the average American people are totally disgusted with the system and the elites who control it for their own benefit. Increasingly it is apparent the common people are looking forward to going to the polls and sending a message.

At this point, the biggest threat to Trump is his own mouth and behavior. None of the GOP candidates are a threat to his winning the nomination at this point in the game. During the general election season the threats are the Biden replacement (assuming there is one), corruption in the form of ballot integrity, and the GOP’s ability to match the Democrat ground game. Having the RINO’s at least give lip service to supporting Trump after the convention would be a help, but it is probably something he can’t count on. Romney, Christie, Paul Ryan, Murkowski, a few other Senators (McConnell perhaps), and possibly Haley and the Bush family may announce they can’t vote for Trump.

Watch also for a surprise on the Dem side. Newsom at the top of the Dem ticket with Haley in the VP slot in order to appeal to moderate Republicans, independents, and people of color. What about Newsom and Condolezza Rice?

There is still a possibility of another pandemic or huge false flag event resulting in the election being canceled and martial law declared. 2024 should be a fascinating year.

Assume Trump gets the nomination and wins. He still hasn’t demonstrated he will be able to assemble a team of highly energized and committed professionals for appointment to key positions and get them through confirmation by the Senate. Without help, the deep state bureaucracies in Congress and the executive branch will tie him down and roadblock his agenda just as they did during his first term.

Look at the swift sea change in Army recruiting in the past week. They’d dropped the woke crap and started recruiting white boy cannon fodder. As we know, Southern white boys enlist at higher rates than other parts of the country.
