BROOKLINE, Mass. — The Massachusetts Supreme Judicial Court on Friday issued a ruling in favor of one town’s bylaw that bans anyone born in the 21st century from buying tobacco products.

In the ruling, the SJC upheld a lower court’s decision to dismiss a lawsuit known as “Six Brothers Inc. vs Brookline,” in which Brookline store owners argued that the town’s tobacco ban was unconstitutional.

The lawsuit also argued that the bylaw conflicted with a 2018 statewide law that raised the legal age to purchase tobacco products from 18 to 21.

If smoking tobacco should be banned, but smoking pot should be legal ... you might be a Democrat.

Old enough to serve and die in the military but not quite old enough to smoke yet.

I think they messed up here. They should have had at least 1 plaintiff that was born after 2000 that wanted to buy cigarettes but was unable to. Not sure the merchants have a discrimination claim but a potential customer would.

That means 24 year-olds can’t buy it.

Sounds like fascism.

They can always come to NH and buy their cigarettes and alcohol all at the same time. Go to the outlet some day and just look at the license plates. It’d be hard to find one from NH.

Side note, anyone else remember that controversy a quarter century ago about whether the 21st century started in 2000 or 2001?

With that reasoning, why allow anyone to buy tobacco?

Whatever happened tro “my body, my choice”? Five year olds can get gender change but 24 year olds can’t choose to smoke. Typical idiocy of the Left.

I have ALWAYS stated that....for both alcohol and tobacco! I was fortunate enough to have just by a hair able to avoid the incremental increase to 21 back in the 80’s. I was raised in Massachusetts..
