Laci Peterson's family and friends removed truckloads of items from the slain Modesto woman's house on Friday, touching off controversy between her family and that of her husband.

Police responded to the Covena Avenue home at about 10 a.m. after a security company reported that the alarm had been triggered, Capt. Greg Savelli said.

Officers determined that Laci Peterson's family and friends were removing items that belonged to Laci, said Savelli, who added that officers documented what was taken.

"We're treating this as a civil dispute over property," he said. "It was clear to the Police Department that this was not a burglary.

Peterson's husband, Scott, 30, has been charged with double murder and faces the death penalty in the killings of his 27-year-old wife and their unborn son, Conner.

Savelli said the fallout from Friday's property removal "was best handled between the families and their attorneys."

Adam Stewart, an attorney for Laci Peterson's family, said the family had been in contact with Scott Peterson's defense team, who had agreed to allow Laci's mother, Sharon Rocha, to go through the house on Tuesday. She was to be accompanied by representatives of the defense team, and all items taken were to be photographed and videotaped.

Scott Peterson's parents and lawyers expressed outrage that the Rochas did not follow the agreement.

Jackie Peterson said the people who went into the home Friday had "absolutely no permission to be in that house. I have a lot of empathy for Sharon, but she does not have a right to go in our house and take what she wants."

Rocha did not appear to be among the packers. Calls placed to the Rocha home were not accepted.

Seven vehicles loaded

Among the items loaded into seven vehicles were a crib, a rocking chair and a box with Graco printed on the outside. Graco makes such products as strollers, highchairs and car seats.

Laci Peterson's family announced Wednesday that it had hired attorneys to help recover items from the house. A list included her wedding dress, jewelry and Conner's crib.

Jackie Peterson told The Bee that the security company notified her by telephone in San Diego County that the house alarm had been tripped.

The property removal appeared to take Scott Peterson's defense team by surprise.

Matthew Dalton, an attorney with lead defense attorney Mark Geragos' law firm, drove to the house and asked reporters if someone had reported a burglary.

Dalton went to Stewart's Modesto law office Friday morning and dropped off some items requested by the Rocha family, Stewart said.

Monday, the defense team moved other items, including what appeared to be gifts, to the Modesto office of defense co-counsel Kirk McAllister, for transfer to Laci Peterson's family. But the items had not been picked up by Friday morning, McAllister said.

Stewart said in front of the home that it would be "ridiculous" to suggest that the Rochas broke into the home.

"I apologize for it coming down to this," he said. "This is not the way we operate. This is for Laci, for Conner and Laci's family. It is not for the media or Mr. Scott Peterson's defense in any way, shape or form. It's depressing that it's come down to this."

Stanislaus County Chief Deputy District Attorney John Goold said prosecutors had no legal authority over the house.

"It's not a crime scene," Goold said. " This is a civil problem between the Rochas and the Petersons."

The house title is in Laci and Scott Petersons' names, county records show. In such a joint tenancy, when one titleholder dies, the title goes to the other.

A Stanislaus County judge on Friday ordered that arrest and search warrants remain sealed in the case against Scott Peterson, who is accused of murdering his pregnant wife and unborn son.

Superior Court Judge Al Giro-lami's ruling also ordered the autopsy reports for Laci and Conner to stay sealed.

Thursday, District Attorney James Brazelton reversed his position and asked to have the autopsy reports made public, and the matter is set for hearing June 6.

Brazelton's about-face came after part of the fetus's autopsy report was leaked to the media. Prosecutors said that portion was clearly "skewed in favor of the defense."

Defense attorneys, coroner's officials, police and prosecutors have denied leaking the information.

Friday, in his ruling on all the documents, Girolami said releasing them "might irreparably harm the continued investigation into this criminal matter."

"Despite the fact that the complaint has been issued and a suspect has been arrested, the investigation and search for both incriminating and exonerating evidence in this matter continues," Girolami wrote.

Prosecutors and defense attorneys argued that releasing the documents could impede Peterson's right to a fair trial and damage an ongoing investigation.

Girolami agreed, saying in his ruling that releasing the documents "might result in the evidence being destroyed and witnesses being reluctant to step forward."

A group of newspapers, including The Bee, are seeking to have the documents unsealed.

Right to view reports argued

Charity Kenyon, an attorney representing the newspapers, argued that the public's right to view court documents was fundamental in an open legal system.

MODESTO, Calif. (AP) - A judge ruled Friday that an autopsy report on the deaths of Laci Peterson and her unborn son should remain sealed along with other search warrant and arrest records.

Superior Court Judge Al Girolami said releasing the information could hamper the murder investigation and prejudice public opinion before a trial begins.

Girolami is scheduled to hear more arguments June 6 from prosecutors preparing a murder case against Peterson's husband, Scott Peterson. Prosecutors on Thursday asked that the autopsy reports be released to the public. They argued that media leaks of the reports are biased toward the defense.

Girolami also ordered that leaks of sealed information stop and indicated he would consider a gag order to stop the prosecution and defense teams from talking to the media.

Scott Peterson, 30, is accused of killing his wife and unborn son, whom the couple had planned to name Conner, last December in their home. Laci, 27, was eight months pregnant at the time. The bodies washed ashore in San Francisco Bay last month.

Contra Costa County authorities concluded their autopsy report earlier this month, but did not disclose the cause of death.

Several media outlets have released details of the coroner's report, and a spokeswoman for Laci Peterson's family members said Thursday they were "devastated" at hearing autopsy reports without warning on television.

The leaked reports indicated the unborn son had plastic tape wrapped around his neck and a significant cut across the shoulders.

Meanwhile, friends of Laci Peterson removed several personal articles Friday from the single-story Modesto home where she and Scott Peterson lived.

May 31, 2003 -- Laci Peterson's mother - shattered by the graphic details leaked from the 25-page autopsy of her unborn grandson - yesterday began removing her slain daughter's belongings from the home she had shared with her accused murderer husband, Scott.

Sharon Rocha, accompanied by several friends and relatives, was seen at the Modesto, Calif., house removing the rocking chair Laci had bought to use when she nursed her infant son, as well as unopened Christmas gifts, clothing, chairs, lamps and artwork.

In doing so, she ignored the advice of her lawyer, Al Clark, that she wait until he, Scott Peterson's lawyers and court officials work out the procedures to be followed when she entered the house.

Modesto police arrived while Rocha was there, and she and her entourage left a short time later after packing seven cars full of Laci's belongings.

Hours later, lawyers representing Laci's family and Scott Peterson started haggling over whether removing the items was legal.

Scott Peterson's mother, Jackie, expressed outrage that the items had been removed since Laci's family had "absolutely no permission to be in that house."

Scott Peterson has pleaded not guilty to killing his wife and their unborn son.

Laci's family said Wednesday that they had hired lawyers to help them retrieve a baby crib and jewelry from the home.

Meanwhile, Clark told Fox News his client's anger over the grisly revelations leaked from her daughter's and grandson's sealed autopsy reports drove her to go get her daughter's possessions.

A family spokeswoman said Rocha was "devastated" by the reports describing how the near full-term fetus of her grandson Conner had plastic tape wrapped around the neck and a large cut across the chest when he was found in the shallow waters of San Francisco Bay last month.

Who is asking the Govt to support them due to a disability? The Petersons'?

They are thousands who suffer from depression at the taxpayers expense. My point was that I'm glad the Rochas are not part of that. And we can differ on this point, okay?

The Petersons maybe in denial over the son but if they truly loved Laci as their own they should have gave the Rochas' their blessing on retreiving personal items as soon as possible.

I'm trying to think back to the beginning of all this, when the Petersons said something to that effect. I can see why they would be upset that their son is considered the prime suspect, but they way they've gone about EVERYTHING including not shutting the hell up after the bodies were found, makes me wonder if they cared for Laci and the baby at all.

I don't disagree. Depression in most cases is treatable and many carry on without losing everything to end up on SSI Disability.

I thought you maybe referring to the Petersons Jackie being on o2 that they are on SSI disability. Which I feel if she can show up for her son and care for his needs she can show up to a job or work out of her home.

When one is on SSI disability I usually think of adults that I know whose retired parents have given up rights to care for them. These are adults who are like my son completely disabled. Or terminal patients who have not one dime left to there name.

As for depression and other mental disorders I have no idea what the deal is on SSI disablity payments.

I know quite a few paraplegics that work in society and would never consider govt. payment. Maybe a loan for school or grants but I do not know if that is private or public.

A dear freind of ours has learning disabilities and is blind in one eye and after a lot of trying is finally starting Nursing school in Jan.

What firmed it up for me was Jackie saying "our house". That was a big slip in the wrong direction.

If they want to help set Scaughty free they should be approaching things waaay more compassionate.

I was thinking of the NE from May that had pics of the inside of the home and now it comes out that Jackie is the contact when the burglar alarm goes off.

How come it did not go off or if it did Jackie P did not call MPD when NE supposedly hopped the fence and got in to take pice. Could she have known they were coming and taken payment for allowing them access? If so it will show up on someones income tax I would think if the some was large enough.

Isn't that covered on their homeowners policy?

Don't think that is covered by homeowners insurance. My lender sells mortgage life insurance. It's pretty expensive, we opt for term life insurance from the same company that has the homeowner's policy to cover the amount of mortgage and some change. Much cheaper. I will say that no payoff on Laci's home has been recorded at this point.

Homeowners policy may end up making a payout to Laci's heirs if they win a wrongful death suit against SP. Didn't OJ's homeowner's policy have to payoff to the Browns and Goldmans?

Too far back for me to recall...Only that I remember that rather hefty judgement the Browns won, that they took pretty much everything of value OJ had.... including that trophy.... They even tried for his NFL retirement salary? couldn't tap into that..

I just think that they have to pay for it, until the criminal process is thru, and pending civil actions... I just hope the Rocha's sue the heck out of the Petersons... ;o)

I don't think it's going to be anyone's house for much longer, much less the Petersons. I really don't think the Rochas care about getting possession of the house. Many people have argued here about who would get it. Better question is who really wants it.

Jackie probably let the NE on the property to get the pics. Somehow it sounds just like her.

If he was paid back membership fees at the tune of $25,000 and only $10 was found on him at the time of arrest plus what he paid for the car. It is possible he has mommy using what is left for mortgage payments.

I cannot imagine the greed of Jackie and son that they would let the house be foreclosed on.

Plus we do not know how much money they made selling the Cafe they sold before moving back to Modesto.

Has to have cash from somewhere stashed to spend it the way he was and on secret affairs to boot.

She was only a sub. teacher so there could not have been any benifits from that job.

You're quite right, of course, Tapu, with respect as to whether these were "satanic killings" or not. It is a side issue and fodder for the media and discussion on threads like these, much like Friday's fiasco over who has legal or should have legal rights to Laci's things. I'm disappointed that a death certificate wasn't issued when it could have been issued, so that the latter issue couldn't have been already been settled.

Jackie must of allowed NE to have access. She had the cops show up because the alarm co. called her to let her know the alarm was going off and she chose to alert MPD.

I had one of thos alarm deals years ago and after teaching the family dog to open doors which he took upon himself to do since. I had to deal with the co. calling me and me calling false alarm and where we live if the Sherriff Dept. does respond after the first time and it is false any calls they respond to after that is a fine.

She obvioulsy had the code which can be changed at anytime so Laci's family was left out of the loop on having the code. IMO another strike against Jackie/Scaught not sharing the code is basically saying stay out to Laci's family.

I think the Death Certificate is under seal with the autopsy. The CC Health Dept. says they can't discuss it. They are the ones who will forward it to the county recorder.

Thanks very much, RG! My, my! I do hope someone in LE explained to the Rochas, especially after their complete cooperation and support of LE and their efforts in the investigation, why they had to seal the death certificate. It certainly complicated the lives of the Rochas with respect to their rights to "Laci's things". JMO, of course.

you have your facts all twisted. IMO, what sent Sharon over there friday morning was Jackie Peterson on Greta, thursday night, saying THERE WAS NOTHING OF LACI LEFT THERE! and that there was no "problem", she didn't know where this problem was coming from, was a media thing. and that she had email from sharon and was going to leave the plants outside for sharon to pick up. i heard jackie myself live when she called in at the end of the show.
The petersons must really hate the rochas to be so mean to them, as to not let the rochas go over and look around, let them have some of Laci's stuff without having to hire a lawyer for goodness sake....hired the lawyers 2 1/2 months ago. Sharon is a saint. i'd have been there long ago.

Great find Howlin. I had not seen this article it really clarifies the sequence of events.

I guess things that have effected our own lives,colors our perception of outside events.A few years ago when my mother was released from the hospital with heart failure,she went home with my sister and separated from my stepfather. A few days later, Mom, my sister and I drove over to their house to pick up some clothes and my stepfather had changed all the locks and alarm system code. I think it was such a shock to my mom that he would not allow her in her own home to get clothes and personal items,it even further deteriorated her health. So I guess I see the Peterson's doing the same type of "mind and power trip" with Sharon Rocha, and that is why I can understand why she would feel goaded into just going into the Laci and Scott's house and retreiving Laci and Connor's things. In a small way, I guess,I feel like I have a walked a mile in Sharon's shoes.

I agree, Sharon Rocha has had the patience of saint along with the rest of her family. She went waaaaay past the second mile to work within the law. IMO, she was pushed over the line by the Bitch of the Decade. Jackie Peterson is a self serving, coldhearted, manipulating b-tch!! It's about time the Rocha's showed that they were NOT going to take this anymore.

I've pretty much made my decision on whether the Peterson's cared for Laci and the baby. It's clear that they did NOT! Peterson's care for Petersons.

This thread is way too long to read all. Has anyone brought up the wedding ring? I heard on FOX today that Laci's Mother found her wedding ring and took it. The story was that Scott had taken the ring and some other stones to have them made into a new ring before Laci's death. Now that is a red flag to me, indicating premeditation. He knew he was going to kill her, but he didn't want to lose the waluable ring. When did he take it to the jeweler? That would be interesting to know.

I was reading another forum, and I knew that Jackie had given two children away for adoption, I believe by the time she was 19, but does anyone know if this other is true? If so, it might help explain why the siblings are not speaking out for Scott, that we see the sisterinlaw most of the time, but hardley ever the actual sister or brother. Is Scott the only child Jackie ever raised?

Jackie was single and pregnant with Scott, her fourth illegitmate child, at the same time Lee's wife was also pregnant with his third child. Lee left his wife and children and married Jackie. Jackie had given away her previous children. Jacko has nerve to show her face anywhere.

The house and all its contents belonged to the husband and wife. If the wife dies, it belongs to the husband 100 percent, including the right to determine who goes in there.

I must agree with you. Laci and Scott owned that house and the property in joint tenancy as part of their community property. Laci's interest in that property is vacated and it becomes Scott's at the moment of her death. However, there is one caveat that must be considered... and I am not certain how it affects this case. In California a convicted murdered is not permitted to inherit any of his victim's property. At this point in time, Scott has not been convicted so the property MUST, by law, be his. When and if he IS convicted, he cannot inherit. But this property was held in joint tenancy... and the laws of inheritance may not apply.

This brings up interesting questions. Can Scott convert the joint assets and utilize the funds in his defense? If his defense costs are such that his assets are completely exhausted and he is still convicted, it would mean that Laci's assets were used to defend her killer... and her heirs, her parents and siblings, would be left with nothing. Does the court freeze the joing assets? Can Scott only spend half of the assets on his defense?

Can Scott convert the joint assets and utilize the funds in his defense?

According to a Stewart Title Co. spokesman, it is virtually impossible to get title insurance on the home as it stands now. So conveying, liening or transfering the house is out. Unless he finds a party who is not worried about the cloud of title.

Title companies look at the cause of death on the Death Certificate and if there is a question with regard to the surviving spouse they refuse to issue title insurance until the matter is resolved, according to the spokesman.

This is not true. In California, a convicted murderer may not inherit anything from his victim.

The title is in both names: Scott's and Laci's.

Generally speaking, in a joint tenancy, when one of the joint tenants dies, the property is divided up to the surviving tenants, said Dewey Weiford, Stanislaus Division president of Stewart Title of California. "However, the surviving joint tenant cannot be the cause of the deceased's death," he said.

Weiford noted that if a death certificate lists the cause of death as unknown or involving violence, the title and sales process is halted and the situation investigated.

Under the state Probate Code, if a joint tenant feloniously and intentionally kills another joint tenant, "the killer has no rights by survivorship."

I am a California attorney, but not a probate attorney. Most couples own their house jointly, which means that upon the death of a spouse, the other owns the house as their sole property. It does not go through probate.

What HAS happened here is that the actions of the Modesto Police Department and the Stanislaus County DA have made abundantly clear that the case must be granted a change of venue. By standing idly by while allowing the victim's family to invade the property of and take possessions currently belonging to the accused defendant, the police and DA have demonstrated the community is irretrievably tainted as far as a fair trial for Scott Peterson is concerned.

I suspect that the inflamatory nature of the deliberate leaks on the autopsy have now had their intended effect.

I look through some of my NE with Laci's house and could not tell if she had rings on maybe someone has back issues they could check out.

I was looking at the house pics and couldn't see an alarm system near the front door or in any other pics. so I was wondering when the alarm was put in.

It says they took the baby crib and a rocking chair and other funiture.

Apparently, similar to the laws of inheritance, the "right of survivorship" in a joint tenancy deed is broken if the survivor caused the death or the other tenant.

Jackie was single and pregnant with Scott, her fourth illegitmate child, at the same time Lee's wife was also pregnant with his third child. Lee left his wife and children and married Jackie. Jackie had given away her previous children. Jacko has nerve to show her face anywhere.

Very interesting, if true, Rusty! Er uh, does this mean that Scotty almost has a twin half brother? Just wondering....if the above is true, was the half brother who is almost the same age as Scott, the one Scott was trying to look like? I mean, like when he was caught with the "chorine" blonde hair and beard/goatee.

Funny how one can become an expert on all that's been reported in this case--in a mere five minutes. The rest of us are just slow: we had to read the media reports since December, and we still don't know everything that's going to happen.
