Spanish judge orders arrest of three US soldiers
Jerusalem Post ^ | Oct. 19, 2005 | AP

A Spanish judge has issued an international arrest order for three US soldiers whose tank fired at a Baghdad hotel during the war in Iraq, killing a Spanish journalist, a court official said Wednesday.

Jose Couso, who worked for the Spanish television network Telecinco, died April 8, 2003, after the tank crew fired a shell at the Palestine Hotel in Baghdad where many journalists were staying to cover the war.

The Spanish judge said he issued the arrest order because of a lack of judicial cooperation from the United States regarding the case.

US officials insist the soldiers believed they were being shot at when they opened fire.

Too bad that Supreme Court Justice Miers would hand these boys over to the tender mercies of the ICC. Thanks, George.

". . . during Miers long affiliation with the American Bar Association, she submitted a 1999 report to the ABA's house of delegates that included recommendations to develop and establish an International Criminal Court and the enactment of laws and public policy providing that the sexual orientation of adults be no bar to adoption of children."

This was battle in the midst of a war. If you aren't one of the combatants or you don't live there you don't belong there. If you are there and get your stupid head blown off its your fault.

"The enemy was, in fact, firing from the Palestine Hotel.

A clue to our friends in the press. If you are standing next to somebody who is firing at US troops, then you are, at best, acting as a human shield for their operations. Do not be surprised when you receive return fire." You wrote

In 2004 when fighting against Sadr and his merry men, French journalists were with his militia. They reported how horrible we were because we were actually shooting towards them! Can you believe that??!! We were actually shooting at the bad guys!

I guess for a French "man" that is a hard concept to understand: Shooting at the enemy.

A spanish judge is threatening our boys and girls
in uniform, serving our nation.
Sounds like a declaration of war by the spanish judge.
Is it proper to threaten a judge from another country?
For this case .... I think so!

Any assault upon our GIs or veterans who were once GIs will be considered an assault upon the USA, Judge, you shi*t for brains SOB!

The insane now reign in cowardly Spain,
all across that foggy, soggy plain,
up to their necks in Islamic nuts,
they hope to appease by kissing their butts.

Hmmm...

I am still in BeNeLux at this writing...and I was going to Krakow...perhaps Slovakia next week - do I need to schedule a visit to Spain? See a man about a judge? do a little extra wet work on the side?

*Sigh* All these sudden changes in my plans...

So the terrorists hide in hotels, with noncombatants, in violation of several tenants of organized warfare, and when they draw fire, the U.S. soldiers are blamed? This is exactly the sort of rank double standard that Israel has had to bear with the Eurotrash; the claim is utterly empty and reveals nothing but the hatred of the U.S.

I don't think Spain has the guts to arrest our soldiers even if they walked up to the court house and told the judge to F**K OFF.

They are a gutless bunch who gave-up to the face of terror moments after their train bombings.

They are not even a country anymore. They gave up their rights to the EU not to long ago. Spain doesn't matter or even exist.

The problem with your scenario is that for international flights...the only way you'd get to Europe from an island in the Caribbean is via Miami or Havana. Most of these islands have few if any flights to Mexico City or South America...so getting that GI out to Spain will be very difficult.

My guess is that they will wait this out until Hillery takes office...which you may have a good laugh on...but its a 50 percent chance that she will win. Within 30 days of taking office, she will likely pull out a list of things to make European allies happy about, and this will be in the top ten. She will probably direct DOD (if they are still in the military)...to transport them to a stockade where a Spanish escourt would take them to Spain after a brief manufactured legal process (likely created by White House terms under President Hillery...don't laugh now...because it is possible).

After DOD refuses to hand these guys over...she will demand the secretary of defense to fire the top general and appoint someone to take her orders. The second guy will likely refuse the order, thus requiring some old formerly retired general (from Bill's years) to be brought back on duty to accomplish "impossible" task.

Meanwhile, the one guy who is likely out of the military and a civlian....will be sought by FBI agents (ordered again by President Hillery). The sought-after guy will likely show up in Texas or Oklahoma...where local law enforcement will gather with some national guard guys to encircle and protect "their local citizen". Hillery will "order" the guard guys to stand down, and will bring in heavy government officials to convince the state to just give up. By this time...around 5,000 locals will have joined up in this mess creating a mega force for the Feds to deal with. The Spanish, by this point, will be laughing because they achieved all this by just a simple Spanish legal request. And Hillery looks like a fool on Fox for her amusing orders to government officals. Retired president Bush then offers his healthly criticism of her "regime".

By the end...the Bush-stacked supreme court will weigh in, and by a margin of 5-4...strangely enough...they tell Hillery she doesn't have the authority to hand US troops over to foreign governments. She gives up her quest...but then sets to a mind to restack the entire supreme court in her favor as each retires...which 3 will likely come up during the next 4-year term.

Of course, there's no mention of what Spanish media guy did to earn a tank shell in his grille. When you run around a war zone as a non-combatant, you do so at your own peril.

This has been my fear all along. That American soldiers would be brought before kangaroo courts around the world and found guilty, if not by foreign governments, than by the ICC. What a brave new world we live in.
