At the SC they hear arguments but don't rule immediately. There are a bunch of cases lined up (this one is from December I believe) also pending votes that Alito hadn't heard.

If the educational institute is really private, let them raise their own funds, not live off Federal monies. Hillsdale does it. Harvard can easily afford to do it.

And any college or school valuing its academic integrity must do it - just say no to Federal funds.

Funding had nothing to do with the decision. It was a straight first amendment decision.

"This case does not require us to determine when a con dition placed on university funding... becomes an unconstitutional condition. It is clear that a funding condition cannot be unconstitutional if it could be constitutionally imposed directly... the First Amendment would not prevent Congress from directly imposing the Solomon Amendment's access requirement, "

Probably not. The big universities that do a lot of R&D will still keep their federal funds. THe sceinces and engineering bring in the biggest chuck of federal funds in the form of research grants. Most grad students recieve a stipend for their research work. That stipend is funded by federal grants. Professors doing research spend an inordinate amount of time writing grant proposals. If they get cut of over the don't-ask don't tell policy, there will be a firestorm from the faculty. The science and engineering departments aren't the liberal socialist paradises like the liberal arts are. Plus, these professors will stand up and fight their administrations if their livelihoods are put at risk.

Air Force ROTC was present on CMU when my son was there too. Only Army had been removed. He had to go to University of Pittsburgh for his ROTC classes. No hardship at all, just strange.
