Court refuses to hear FLDS mothers' request All FLDS children in Texas now off to foster care

SAN ANGELO, Texas — The last of the children taken in the raid on the Fundamentalist LDS Church's Yearning for Zion Ranch are now adjusting to life in the foster care system. Escorted by police cars and ambulances, more than a dozen charter buses rolled out of the San Angelo Coliseum grounds Friday, carrying the remaining 260 children toward foster homes.

Small children waved as they went by. Some appeared to be very young; one child was seen holding a bottle.

"It's a good day for them because they're out of this shelter environment and getting to more stable places," said Chris Van Deusen with the Texas Department of Family and Protective Services. "They're still temporary homes, but it's more conducive to child care."

The departure from the coliseum, which has served as a massive shelter for 462 children and dozens of their mothers in recent weeks, was still emotional. On Thursday, many FLDS mothers were separated from their children.

The children will be heading to foster care facilities and homes scattered across Texas. Mothers are being allowed to stay with tbabies under 12 months of age; the others have been separated.

Meanwhile, attorneys for the FLDS Church threatened lawsuits against the numerous government agencies involved.

...

Meanwhile, parents who have been cast out of the FLDS Church have been coming forward to help establish paternity. Some had no idea their children were in Texas.

"We are hearing from parents who tell us they were forced out of the FLDS, and they believe that their children may now be in DFPS custody," said Rolfe. "We are making arrangements for those parents to submit samples to labs that are close to where they live."

Which is why the judge must be impeached. As I said, not even doing basic investigative work—and even confirming in the warrant itself that the suspect wasn’t registered locally—shows a careless disregard for justice and the Constitution.

Your cut and paste is getting old.
Your are also getting somewhat shrill.

actually stauatory rape varies state to state

the law that got Jeffs in Utah as an accomplice was the 3 year age difference if a girl is under 18 ...she was 14, he was 19

marriage in Texas is 16 and up with parental approval...a given in this sect

under 16 needs court approval but FLDS will claim as they did to escape polygamy laws that these are not civil marriages but religious unions and then the stauatory rape thing becomes probably an issue and in Texas the law says “Sexual assault for anyone to intentionally or knowingly penetrate a person under age 17, other than his spouse. The actor has an affirmative defense if he is not more than three years older than the victim, who is at least age 14”

has anyone read the news articles on Jeff trial?

lord a mercy what a mess of stuff....I had no idea...this girl did not claim rape till 7 years later when she filed for monetary damage and she had left the first husband 3 years before after cheating on the first and getting preggers with second man who she married after she left the first one Jeffs had arranged her to marry.....and it goes on and on.

I could make this stuff up...

“I believe that the way to hell is paved with good intentions. “

I believe there are those who take the path to hell, believing it is the path to heaven.

For instance, the teachings of the FLDS sect at the YFZ Ranch.

Jeffs has distorted the original teachings to the point of declaring himself PROPHET, and setting up a LOYAL INNER CIRCLE of men who are rewarded with the riches of the church, and allowed to vent their impure lust for children, as a ‘guarantee’ they will remain loyal to the PROPHET who picks females from the herd, to be their mind-numbed slaves.

Other than that, I think the folks of the FLDS are fine people.

I hope they root out all the sinners and can return to their simple life with a good leader who cares about them all, serves that community, and the Lord.

The “informant” wasn’t the source of the info for the warrant (else the raid would have been earlier). The hoax call was—and there was no confirmation of the veracity of the caller.

That may very well be true, but determining who goes where is not a function of government.

Fine people may be going to hell, but they generally shouldn't have their children torn away if they aren't violating the law.

it happened the way it did in 1953 because not much was proven and folks got less time for such crimes

the women and kids went back to Short Creek voluntarily

what about the other 30K polygamists?

and the non-FLDS folks who arrange early girl marriages?

these are the only sect

CPS is doing its best to be sure that can't happen! What a tragedy it would be, in their eyes.

“The arrest and search warrant was April 3, 2008. Have you not read it? “

I guess I’m not being clear.

Dale Barlow was the primary in the first arrest warrant, and he supposedly has an alibi, while the complainant has not been positively identified yet. May never be.

If the DNA tests confirm other cases of sex with a minor, then there will be more arrest warrants.

I understand what you are saying about the original arrest warrant, and agree it could cause a legal challenge down the road for the criminal case.

But, in this temporary, protective custody, controlled by the CPS at the ruling of the COURT, the arrest warrants are not relevant.

Can the CPS ignore the Constitution?
Well, if that’s the case, then it has been going on for a long time.

Do you think the Judge in the Custody Case knows anything about the Constitution?

“but they generally shouldn’t have their children torn away if they aren’t violating the law. “

So, when we find out whether they are violating the law, which should be soon... then we can take the children away that were needed to prove they were violating the law?

I understand what you are saying, but if all the evidence points to some kind of abuse going on, then someone is breaking the law.

Since they are all ‘confined’ to the compound or on a leash when not,(figuratively), then it is likely someone in the compound who committed the crime.

Or should we have raided the Cowboys Football Stadium?

Well, if they are breaking the law, the CPS and LE in those states and communities ought to investigate.

“CPS is doing its best to be sure that can’t happen! “

Funny, that’s not what I have seen or read.

Extreme measures are being taken to allow the children to continue practicing their faith, following the guidelines of their sect as far as food, dress, exposure to TV/computers, boys, girls, etc, color of clothing, you name it.

ALL in the belief that they will be returned to the families at the YFZ Ranch, if they are not an abuse subject, and in some cases, reunited with their REAL PARENTS, who are just now finding out where their biological children have gone.

“The hoax call was—and there was no confirmation of the veracity of the caller.”

OK. Let’s say the hoax call was what got the search warrant.

So we invalidate the whole raid, and return the women who chose to go to shelters rather than return to the compound.
We return the children to the compound, care of GENERAL DELIVERY, since we have no justification to identify their parents, whether they be biological, or just the ‘current ones’.

Even thought the physical evidence was there, in our hands, we let it go because the call that CPS was NOTIFIED OF, turned out to be a hoax. Even though it doesn’t matter that it was a hoax, as far as CPS is concerned.

And, every one is aware that the abuse occurred, because of the physical evidence.

And you have the statements of an ‘informant’ from the compound, and the statements of women who escaped the abuse, and lived to tell about it.

So, as an American, and a Christian (I assume, but not required), what do you do now?

I think you are gonna find that relying on the hoax phone call as a legal loophole that invalidates the whole case to be thin ice.

And I’m not accusing you of supporting any crime because you see a potential problem with the case. Just to be clear.

I am a retired policeman, the call gave the police ‘reason to believe’ that a crime was being committed and they acted on good faith, change that to HAVRE to act in good faith,

I pray to God that this whole thing works out for the welfare of the children and punish to offenders.
