Court: Texas had no right to take polygamists' kids 3 minutes ago

SAN ANGELO, Texas - A state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect's ranch.

The Third Court of Appeals in Austin ruled that the grounds for removing the children were "legally and factually insufficient" under Texas law. They did not immediately order the return of the children.

Child welfare officials removed the children on the grounds that the sect pushed underage girls into marriage and sex and trained boys to become future perpetrators.

The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings.

One judge and investigators are still trying to determine what is going on. There is enough to show that their should be a thorough investigation.

The appellate judge ruled on information it didn’t even have in front of it because of the ongoing investigation.

It has been reported that the State has nobody at the sect collecting welfare in TEXAS. If and when the State comes out and retracts that then you will right. At this point in time, nobody is believed to be on any government assistance whatsover.

You gotta relax and quit spouting non-facts because somebody told you something and you believe it out of convenience.

I'm more than a bit concerned that the appeals court judge completely ignored the fact that the adults in the FLDS actively obstructed the CPS from determining which children were from which household.

The law does consider children to be at risk of abuse if someone in their household abused another child.

The appeals court judge says they improperly treated the entire ranch as one household, but doesn't address the problem with determining who was from which household. Doesn't even mention it.

While I still think that every adult in the compound was complicit in those rapes, the immediate threat of abuse would appear to be removed by removing the men who were allegedly abused the girls. With the immediate threat of direct abuse removed, the kids could remain with the remainder of their families while the criminal investigation and prosecution occurs. Or they could be removed again if additional evidence of a direct threat surfaces.

Lack of proof because you don’t see a marriage license that cannot exists because of a possible bigamy charge.

Imagine if you are a 13-year old girl being forced into sex with a freak and told that you are “married”. Imagine what it will be like when they get into a position of reality and find out their “marriage” is a farce and they have no legal protection under the law.

Sorry basically the entire case is about done. They had no right to take all the children. It comprimised any hope for correcting wrongs and arresting offenders. They screwed up bad. As many of us knew already. Just because it “feels” right, doesn’t make it right legally. We have protections in this country for individual liberty, and against guilt by association.

Yes, you did get the information wrong. How do you know how old they are? How is the person reporting knowing how old they are? There were so many different answers given and lies told, not to mention that no birth certificates are around to show jack. The pedophiles knew to not keep that information to show the age of the girls when they started raping them.

Problem is, these are the same people who will be after you and me if the gov’t ever declares something we are doing to be a ‘crime against society’. Like teaching our kids that Christianity is true or that homosexuality is wrong or something radical like that.

That’s why I said “’training’ in democracy”. The Germans used similar methods against various peoples in the last century proving that people don’t change, just the methods used to manipulate them.

Why don't you post a link to the Texas Ranger report that detailed specific abuses seen.

Copy of Texas Ranger's affidavit.. Interview and witness details start at the end of the second page. This is describing what was seen or discovered in interviews based on search warrant M08001S on April 5th.

This contains the DFPS affidavit from April 10th.

There are several other documents that are available that the media hasn't reported on I'll dig up, including the search warrants themselves.

You are so wrong. Whereas the MEN received work contracts and money coming in from such, the women, or girls who were NOT LEGALLY married to the men were and are collecting welfare for those kids..


I’ve seen this alledged in various threads and have asked for links to verify the assertion. Do you have any links?

I’m not requesting verification of other states but only verification of the women or any FLDS member drawing welfare of any type from the State of Texas through their system.

None of them were on the records of the State of Texas as receiving public assistance through a Texas program. Most of them moved to Texas recently from Utah and Arizona, where huge rates of welfare dependency have already been documented among members of this sect. Since many of the women and children haven’t been solidly identified yet, and their names change whenever they’re “reassigned”, there’s no way of knowing how many, if any, of the ranch residents were still receiving welfare payments via Utah or Arizona.

It was stated explicitly yesterday that NONE of the members were on welfare. Stop spreading lies.
